We live in a one bedroom apartment with our one year old and will be having another baby soon. We are only allowed 3 people in our apartment- I didn't see anything in the lease about a situation like this- what usually happens? Additional Details We WANT to move- as soon as possible- the space thing is driving us crazy- but I'm not sure how to go about it- if they want us to transfer to a larger apartment in our complex it is too expensive, so that would be a problem.. but there are plenty of other larger apartments we could move to. Also, our baby isn't due until April but they've already had to stop my contractions once.... we suspect he will be born soon! But moving RIGHT after he is born would be crazy- but moving NOW would work. |

S E, spend your time seeking other accommodations in the early stages of your pregnancy, and if you can move b4, move.
A LL can not force you to move because you have children and/or get married, but they can stop you from moving in if you have to many people to suit the dwelling.
If your on a month to month, give notice and mention to the LL in a face to face conversation that your delivery is in April and you will try to get out soon as you can.
Further, if you are on a lease, you may want to see how the lease co-insides with the birth, so if the LL bocks with the move because of the occupant impact, mention that if he has another apt with adequate accommodations and similar prices, you'll move forthwith.
I move my longtime tenants all the time and consider their needs in addition to mine and override my leases to accommodate a birth or marriage. |

You should really start looking for other living accommodations, not relating to what your lease says. Two adults and TWO little children in a one-bedroom is simply not practical, even if your lease allows same. You will find yourselves literally tripping over each other in short order.

I am not sure where you live, but here in CA, the occupant standard is 2 per bedroom plus one. Anything less then that and the landlord cant say/do anything about it. It could be similar to your state. |

That's a tough one. Having a little one and another on the way makes for a very busy life, so I can see how you wouldn't want to move.
However, its important for you to know that there are laws and regulations that will require you to move aside from having more people than your lease allows.
For example, in most states, children must have their own bedroom seperate from their parents. (this includes children who only live their part-time. Eg every other weekend)
In some states, children can share a bedroom if they are of the same sex. -eg 2 boys or 2 girls. However, often times if its a boy and a girl, they can only share until the youngest turns 1 year old and then they need their own seperate bedrooms.
I would recommend that you contact Family services to find out what the laws are in your state. You can make an anonymous call if you don't want them to know who you are.

I know if you're in a rent controlled situation like HUD housing, they will force you to move to a bigger apartment, or at least put you on the waiting list for one.
If you're holding a private lease, when it renews, you may be asked to move if your neighbors don't complain about the noise first which could get the attention of your landlord and your over the limit occupancy situation immediately. |

It's usually not on the lease, but it's state law.
If it's state law, it need not appear in the lease, but a good landlord will point these things out to you if they know you already have one child.
That prevents parents from stockpiling children into too close of quarters b/c that creates a health hazard and a poor environment for children to live in.
I understand not everyone has the money for a 2-bedroom, but 4-people living in a 1-bedroom apartment is too many.
The apartment complex can legally ask you to move, but they cannot charge you a penalty for breaking the lease because you had a baby, and it would violate housing code to allow you to stay there....if you cannot afford their 2-bedroom rate and needed to move someplace different to find something affordable.
UPDATE: Your landlord doesn't have to accomodate a baby that isn't here yet....I know that sounds absurd, but that is the way the law works.
Keep in mind that you will get SIGNIFICANT notice to move...it's not like you are going to have the baby on a Monday and they are going to make you move the next day.
Please don't stress over this! |
