LRC | What happens if your landlord services you eviction papers but you pay immediately and avoid going to court? |
My landlord served me eviction papers for past rent but I paid it right away so I avoided court and was able to stay in my apartment. I stayed for an additional 10 months until she sold the building. Now she is asking for the legal fees associated with the eviction. Do I have to pay these since I never went to court? Can she wait 10 months to ask me for the legal fees? |

Tell her you believe she went to the office supply, bought the forms, and filled them out her self.........the scare tactic worked, there are no legal fee's.........she got her rent for the next 10 months.................once she servered you, then accepted the rent, shes out, and back to sq. one..............99% of the time, once theyve paid the filing fees,

Once the eviction process starts, the tenant is liable for all court charges and filing fees. Just because you paid your rent at the last minute, you are still liable. She should have collected the rent, late charges, court fees, attorney fees, processing fees, before she stopped the eviction process.
It probable was an oversite on her part or she did not have the awareness at the time. |

Read your agreement. It may well state that you are liable for court fees incurred as a result of late, or non payment of rent. Read it carefully. If it omits this clause you are not liable. Most include it though. |

Yes, you're liable for legal fees. Courts and sheriffs do not file evictions or serve summons for free.
She was probably planning on recovering the legal fees from your security deposit. However, she hopefully turned the full security deposit over to the new owner. So, she is stuck trying to collect from you now.
You need to verify that the new owner doesn't also own the entity that sued you if the old owner sued you using a business name. |

Do go to court on the appointed day. That is when she will ask for the legal fees and you can explain that you paid. And you could get the judge to tell her not to keep the legal fees out of your security in 10 months.. |

Ignore the first poster, and them rushing to pass judgment on you. I believe that there is a statute of limitations on recouping on fees such as legal fees. If she has never pursued them before, I can't imagine what legal ramification she has to go after them now. I would advise seeking a lawyer that provides free consultations (you can google them), and ask them the same question. |
