of course it will go to your mother unless he has a will stating otherwise.

If your father had a will/estate plan, his estate will be probated and the interest in the house settled according to the will. If he died without a will, state probate law prevails.

Assuming they were still married and had purchased the house as "joint tenants", which most do, but the deed will tell you. You can check with the county on that. If he has no will, the entire estate may go to probate. You might want to talk with an estate attorney, just a consult to get some firm answers to your questions.

If they were still married at the time, and unless there is a will stating otherwise, the property belongs to your mother and any of his children. Half to the mother, and the other half divided equally among the number of children. You can't saw a house in half legally, nor divide up a few small residential lots. The property would be sold, and the proceeds divided in the proportion stated above.

(Sorry for your loss. My father passed away some time ago. '81. This is what transpired. No will was left,{Knowing my Dad, he probably spaced it. Too busy with the intricate world of electronics. Also too much intellect, and probably considered it a nuisance! lol!}, so his property, tools and what have you, was to be divided as half to his wife, and the remaining portion divided among his children {2} My brother and I, signed everything over to his wife. We didn't earn it, and felt she deserved it)

If they are legally married--yes it should. Did he buy it while they were married? Was she on the loan with him? Anyone else on the loan?

I expect that it will go to your mother. However she may need to check with the lawyer to get all the details. Sometimes there is a clause/insurance that if mortgage holder dies, house is paid off.

The will is probably irrelevant, because the house is probably titled in both your father's and mother's names. Look at the deed first. If they held title "jointly" or "with right of survivorship" or as "tenants by the entirety" or as "joint tenants" then the house goes directly to your mother. No will is involved. No probate is involved. But she still owes the money on the mortgage.
