What happens to the months rent I paid in advance?
I have just recently taken up a new tenancy. I am claiming Housing Benefit and have requested that the cheque goes straight to my landlord. I paid a month's rent in advance when I moved in and I have recived notification from the Housing Benefit that they have backdated my claim to the date I moved in which means my landlord has received last months rent again. Does he keep this, or am I entitled to it back?

You are entitled to it back. The Landlord cannot receive two lots of rent payment for the same period of time. Assuming the council have now paid your Landlord, I would contact him and ask for it back.

Was it requested that you pay the equivalent to a months rent as a deposit, in addition to a months rent? This is generally the norm. You then get the deposit back minus any charges for property damage at the end of your tenancy. If your not sure check your tenancy agreement or contact your landlord.

your landlord is probably keeping the first months money as a bond and you should get it back when you vacate the property providing it is in the same condition as when u rented it (with reasonable wear and tear). ring your landlord to clarify but im sure this is the case.

You are entitled to a refund of any overpaid monies. Ask your Landlord to supply a statement of (rent) account and if you have indeed overpaid he MUST refund you. Good luck.

Did you not need to pay a months deposit as well as your month in advance? That is usual practise then the deposit payment is returned at the end of your lease if there is no damage. Any damage the landlord takes out of the deposit. If your landlord didn't ask for this, have a chat with him or he and see if they'll return the month's money.

If your landlord has actually received 2 cheques for last month's rent, you should get your money back, given that you've applied for and been approved for Housing benefit.

i would ask your housing benefit place and then the landlord. your landlord should know if you get it back or if they get to keep it.

YOU SHOULD GET IT BACK AS YOU HAD ALREADY PAID HIM. HE MAY DECIDE TO KEEP IT AS AN EXTRA DEPOSIT. JUST KEEP A NOT OF HOW MUCH HE OWES YOU,FOR WHEN YOU MOVE OUT.

Yes claim it back,personally, i would change it so that the money goes to you, and pay him by standing order each month,Landlords are nightmarish when giving money back,so if he won't refund the OVERPAYMENT you can withhold the last 2 months rent when you leave the property,it's a good way of getting deposits and rent in advance when you find you want to move.
