Kathie | What happens when you have an accepted off on a house and the house is AS IS and it needs repairs? |
We are buying a house and we have an accepted offer. It is "78,500 seller pays up to 3% at closing and the house is AS IS condition". Upon inspection we found that the boiler has 2 leaks. Our lender is requesting that everything be in working order. The seller is a bank and it always takes a couple of days to get back to us. What can we do to get everything in order to buy the house for the lender. |

You can ask that the bank make the repairs, even though the contract states the home is as-is. If those are the only things holding everything up and they're not expensive the bank may decide to do it just to get the house sold. If the bank won't, and your lender won't let you close until they are repaired, you are going to have to pay for it to be fixed prior to closing, or find a lender who'll loan you the money without making the repair.
If you don't want to pay for the repair and the bank won't, provided your purchase agreement was contingent upon a satisfactory inspection, you could back out of the sale and should be able to receive your earnest money back. |

The problem is that you apparently signed an "as is" contract but your lender won't agree to that. Does your offer and contract contain an inspection contingency clause and are you still within the window for that contingency? Your realtor should be advising you here. |

YOU have to pay for repairs when it is sold As-Is and it's pretty much impossible to do that until you actually own the place- you could be looking at major repair costs, especially if boiler needs replacing

You are buying "as is" which means the seller won't fix anything. Most of the standard "as is" contracts permit the buyer to cancel if they aren't satisified with the inspection. If you really want the home, you will have to pay for the repair prior to closing. If you go that route, make sure you get a firm commitment from your lender that's subject to repairing the boiler before you spend the money to fix it.
