Only a lawyer can explain your local and state laws regarding this subject. Many lawyers will give you advise for only a small fee. Call a lawyer referral service and they may even waive that fee.

Normally, there is an inspection for WDO. If they did not find any, they can sue the inspector.

No, not two years later. Termites can do a lot of damage in two years.

That is, unless they somehow find out you knew about it and didn't disclose it. But how are they going to do that?

Difficult to say.

If this is in the US, then it will come down to a few different factors.

One of the seller's conditions of her offer should've been that the home passed inspections of various sorts (including one for pests.) If she did not list that as a condition, or if she waived it at any point, she's going to have a very difficult time coming back later and pointing the accusing finger at you.

She may try to say that you were aware of the termite infestation and should have disclosed it. However, that still would not have been an issue if she'd followed standard practice with a conditional offer. Also, the burden of proof will be on HER to prove you knew there was a problem, unless you signed some kind of home warranty (which I doubt, or you'd be unlikely to post this question!)

No, because she could have brought them in during that time. Unless she can show there was an infestation of them beforehand and that you had made any attempts to rid the place of them. Them she could sue because you didn't disclose a present danger which you were aware of.

No. The house should have been inspected before the mortgage company let them buy it. However, If you knew that the house had termites and did not disclose it prior to closing you may be libel.

What. Not hardly. If she wants to sue, let her, but she's got a loosing case unless she can somehow prove that you knew about the termites when you sold the house and covered it up. But even then, your state has to have a law that would cover those circumstances. I think she's trying to scare you into coming up with some money or something. Don't fall for her tactics.

Owner of what? Not a lot of details in your question...

I would imagine that the owner would need to prove that the termites existed when you owned the property and that you sold the property knowing termites were there. That's a tall order, so I think you're safe.

I'm just guessing here... check your local laws.

Maybe. If you are selling a house, YOU MUST DISCLOSE any known defects. Do the right thing!!!!!!!

The new owner should have had an inspection. Most mortgages require it (including a termite inspection).

Read your sales contract to see if you are responsible for the repairs. Usually after 1 year, you're not liable for any damage what so ever.

Buyer beware,,she should of hired a home inspector. If she did, than they should of found them. If they just showed up (the termites), it's not your fault. Termites fly.

If you know there are termites and don't disclose that, and the new owner learns it 2 years down the line, you may well be obligated to pay for it due to failure to disclose.

Ask your realtor.

If there is a termite bond, the termite company will take care of it.
