You have four options.
1. Let the property go into foreclosure. (credit decimated)
2. Give the lender the deed in lieu of foreclosure to save yourself the additional fees associated with a foreclosure. (credit almost decimated)
3. Sell it and pay the $68,000 at the closing table (credit safe)
4. Have the initial foreclosure proceedings occur and then contact your lender about doing a SHORT SALE (where the lender agrees to take less money than what is owed on the property ... this is where your private mortgage insurance comes in handy). If the lender accepts you walk away from the debt in full. (Credit will suffer some, but not near as bad as a foreclosure)
The bottom line is that you can't sell your property until all liens are removed (a mortgage is a lien). |

If you can not sell it for the note, then it will be up your lender to decided what price lower then the note will they take, IE the short sale, would they approve a short sale for 99K? on 167? probably not
if the lender will not work with you then either you stay current with your payments or the bank forecloses |

This is how investors make money, they buy homes for a fraction of what is owed, then either rent them or rehab and sell them for fair market value.
If it worth $167,000, why would you take a $68,000 hit? That makes absolutely NO sense.
You are going to have to come up with the money for the difference, short sale it or let the house foreclose.
Try listing it with a Realtor that knows REO's and short sales, then start negotiating with the lender.
Tell that investor - NO DEAL. |

Steph, you need to be talking with your lender and making arrangements with them. There are any number of things lenders can do, but the question is will they.
I wouldn't accept an offer that low unless your lender says it is ok. You could be on the hook for the balance big time. They could demand the balance at closing. The lender could file a IRS 1099 form grossing up your income and tax liability. So talk with your lender first. Push and get in their face if you have to.
Regardless, you credit will take a hit, if you don't pay the mortgage. I think the majority of Americans will have pissy credit when this is all said and done. |

You can talk to your mortgage lender and tell them that you have an offer that less than the mortgage amount. Ask them if they will consider a "short sale". If they agree to it, they are essentially forgiving the shortfall and you will not owe it. If they do not agree to it, they can ultimately come after for the money.
You could always sell the house and take out another loan for the $78K shortfall. Your payment would be less than your current mortgage payment on $167K. |

If you can afford to, keep the house until the value catches up with what you owe on it. It is a roof over your head and as long as you are making the payments you can maintain your credit rating. You might ask yourself this,"Is my credit worth 17"K? and the answer is yes yes yes. The market will eventually change in your area.
Of course, if you must sell, then the short sale is the only way to get out of it. Good Luck! |

It sounds in your specific situation, you should just walk out on the house. Write your state rep and the guy in the white house a nice letter with lot of four letter words.
