You can break your lease and turn over the keys and the landlord might still come after you for $$$. So, the trick is to make your case for convincing the landlord to agree to end the contract. (What these other folks won't tell you is that the lease can be terminated anytime if both parties agree.)

Renting is a business deal, so try the businessperson's approach: make an offer. In Texas, apparently, the going rate is one month's rent plus the deposit. Wave that under the landlord's nose and he might be happy to let you go early. He knows he can re-rent and score an extra month's rent to boot!

Your lease might even be defective. That can be a good argument in your favor, too. All it takes is a little sloppy work on the landlord's part, and you have something in your favor.

You might find the defect that makes the place "uninhabitable." You might find the code violation that exposes the landlord to fines.

You might start a tenant's group and the landlord will show you the door, rather than deal with ALL tenants making demands.

Now, you need to know exactly what the lease says, and you need to know how your state and local laws govern your situation. The bad news is YOU gotta do some readin' and understandin'. The good news is that there is a LOT of information from tenants' rights groups and lawyers on the web. Google up your state + "tenant landlord law".

You are liable for the entire term of the lease. If you break it, the landlord needs to make reasonable efforts to re-rent the unit at the same rent as in your lease, but you have to pay the rent in full until it is leased to another tenant.

With the economy being so distressed, many landlords are finding it difficult to lease good properties, even after reducing the rent. You would expect that with so many people losing their homes to foreclosure that the demands for rentals would be increasing, but it seems they cannot afford to rent, either. They are doubling up with relatives, moving back in with elderly parents (who can no longer afford the property taxes even though they no longer have a mortgage), etc.

Breaking your lease is bad idea if there is any way to avoid it. You may well end up paying the rent, but where are you living and how much is that costing you?

I broke my lease a few years back. I lived there for 4 months and it was a year lease. I wanted to get a dog and the apartment complex would not allow them. Basically I called the landlord and requested out of my lease. He let me out of my lease and I did find 2 tenants to move in to ensure I would not have to pay for rent when I did not occupy the unit. I thought everything went smoothly but he did take $600 of my $1000 deposit. I tried to fight it but he charged me for repainting the walls and finishing the floors (hardwood). I tried to fight him for it b/c I did leave the apartment in the same condition I rented it but at the end of the day he allowed me out of the lease so I let it go. Follow all the paper work and make sure you get things signed and take pictures of the place when you leave. Good luck. State: CA

If you had read your lease agreement before or after signing it I'm sure you would know what the terms are. Try it now, it's not too late. LOL

You can break an apartment lease or leave a few months earlier, before the lease ends, but you will face penalties.

Check your lease for the termination terms/penalties!

I am sure you will lose your deposit, pay a termination fee, have to payback the difference of the all "special" you received while you lived there & the regular price for apartment...not to mention any damages you may have in the apartment...

But if you can afford to pay the fees, you can work something out with the leasing office. It is possible. They may agree to arrange payments if you can make them within 90 days. But I gotta warn ya, it's going to be expensive.

california has it own laws. but if you give 30 days written notice in some states thats good enough. and also a good reason. sorry ,you should talk to
a lawyer before you sign anything these days.

Go to the Apartment's office and ask for a copy of your leasing contract. It should list the terms of agreement and what you would have to pay if you broke your leasing agreement early.

When you go, you don't have to tell them that you're thinking about breaking your lease of course, just ask for a copy of your lease agreement.
