My fiance, 2 months ago, decided to get an apartment with a lease of 6months before i decided to move down to live with him in Texas. Our landlady is a witch! She is scamming us of our money, is really shady, and NOW she decideds we cant have our puppy there anymore, and didn't re-make the contract for us to sign.
We put a $300 dep. down and we pay $350/mo. We have been living there for 2 months now. What is a good excuse?? |

The puppy is an issue which she could actually demand that you get rid of if it has caused damage or in any way breaches the lease.
Does your lease state that you can have a puppy? If so, are there specific conditions to having the pet?
Most landlords use pet addendums that set rules which must be followed in order to be able to keep the pet on premises. If you (or your puppy) breach the addendum, the landlord can terminate your right to a pet.
The only legal reasons to break the lease is orders from the military and if the place is deemed uninhabitable. Otherwise, the landlord does not have to let you out of the lease without it costing you $$$.
If you have a lease and break it, you can be held liable for the rent until either a replacement tenant is found or your lease expires.
The landlord can also hold you liable for any costs she incurs due to your breach, such as advertising costs, agent fees, etc.
If you do not pay the amounts above, the landlord can sue you. The judgment will include not only the costs mentioned, but court costs and accrued interest until the judgment is paid.
Your rental and credit histories will be ruined. The judgment can be renewed for up to 20 years and the landlord can garnish wages or bank accounts, place liens on (future) personal property, etc.
Future landlords will deny renting to you due to the unpaid judgment. Many employers check credit, so you can be scrutinized for having the open judgment against you. Insurance companies and other creditors pull credit and adjust your rates dependent on your credit, so you will be paying higher rates for many years.

You have renters rights. She can't make a sudden switch in the contract without giving you ample notice and having you sign it. You will more than likely lose your deposit if you break out early. I wouldn't blame you for leaving though. Does it say something about breaking lease early in the contract? I would double check that. If it says nothing about you losing your deposit but when you tell her you want to move out if she doesn't want to give it back, I would consult a lawyer. She has to listen to her own contract too. It's her own fault if she didn't cover her behind on things like that. I would also install some form of lock or security system if you think she it breaking in, since you said she is shady. We had a system once that when the door opened it would set the alarm and call your phone. You had the option to turn off the alarm sound so the intruder had no idea. So that way you would know if someone is entering your apartment. Good Luck, hope it all works out for you! |

I would just leave... as long as you give notice, even though it may not be fullfilling your contract you should be okay with your next landlord. Iwould just be open about it when you apply to your next place... or apply to a new place before you leave the one you're at. |
