Get yourself a solicitor and he/she will advise. Many solicitors also have estate agency sections and will arrange everything for you. This is the best way and they won't rip you off.

I'm not sure if you are entirely clear about what selling your flat privately actually means. I f you sell it privately you are basically selling it in the same way you might sell your bike to your mate, i.e. you have reached a private agreement with your mate or an other party having not advertised the item ( in this instance the item being your flat) for sale publically. That said you will still require the services of a solicitor to complete the transaction.

You can opt not to involve an Estate Agent in the selling process but that means that you will need to organise advertising/viewing amongst other things by yourself. You will still need to appoint a solicitor to act on your behalf in order complete the transaction.

Please note that under Scottish Law once you accept an offer for your property from a buyer you are legally bound to go through with the sale. You cannot accept a higher offer from another buyer having already accepted a previous offer meaning that in Scotland buyers cannot be "Gazumped". Once agreed if either the buyer or the seller pulls out of the sale then the financial penalties are extremely severe on the respective party.

I would recommend seeking proffessional advice as a matter of course before deciding how you wish to handle the sale of your property.

Depending on where you live i would suggest the following;

Strathclyde: Glasgow solicitors property centre (GSPC)
Tel:
Lothians: Edinburgh solicitors property centre (ESPC)

I would certainly recommend getting in touch with either of these organisations even if you are outwith their catchment area they will put you in touch with your local solicitors property centre. And solicitors are better regulated and policed than estate agents should things go wrong!

You'll need a solicitor for the transaction. Also some Estate Agencies are very effective at getting the very best price for your property. Most areas of Scotland are booming at the moment. House prices on the east coast have rocketed due to better road networks.
