What is the difference in land zoned residential, commercial, or agricultural?
Can I open a business on land zoned for agricultural use? Can the zoning be changed after you purchase the land? If so, how difficult is this to do?

I want to open a dog park (evenutally) and I've been looking for land. I need at least four acres and I found a great lot, but it's zone agricultural. I'm not sure if they will let me open my business there, but I need to know before I buy it. I can't be stuck with farm land!

What is permitted in differently zoned property is governed by your city or county depending on jurisdiction. Before you purchase property, I would contact the planning or zoning department of your city or county and talk with the planner. They will tell you what is permitted on this property. If your use is not listed for the current zoning, then they will have a process where you can petition the Planning or Zoning Board to rezone the property. There will usually be a rezoning hearing where your neighbors get to comment on your proposed use of the property. Based on this hearing, the Board may approve or deny your request. You can make getting the property rezoned for your use a stipulation of the purchase. Then If it can't be zoned for your use, the contract to purchase would be void and you would not be obligated to buy the property.

Depending on the Residential Zone, it could allow single-family dwellings, multi-family (apartments, condos), or possibly neighborhood business.

Commercial Zoning would be for businesses, factories, and other similar uses.

Agricultural Zoning would be for farming, raising livestock and the businesses associated with that industry.

it depends what kind of business you want to open. Before you purchase the land go to the local county office and find out what the property is zoned for and if it can be rezoned. The rezoning process can be long but worth it.

Find a commercial Realtor who can help you with it. As a buyer you don't pay a commission unless the property is sold by a person who is not represented by a Realtor. Also, a commercial Realtor has knowledge of the process, area and businesses.

pretty self explanitory

Residential means just regular houses...commercial means you can turn your property into a business and agricultural means you can farm your property and have animals like horses or whatever else you want...they zone it liek this so that if your in a residential area the guy next to you doesnt have horses n pigs you gotta smell or the guy across the street isnt running a bar...that help?

Zoning determines what you can use the land for and how it can potentially be subdivided. A commercial business can not be erected in an agricultural/residential district. If it is done, the county can force the business to close. This is not including a business that is run out of a person's home, as long as covenants/restrictions don't forbid it.

Residential zoning can either be RA - low density single family homes and up R12 being high density, condo units and apartments.

Agricultural allows for livestock and farming and is low density. Sometimes can't be subdivided. Each county has their own requirements on lot size and road frontage.

Commercial is business use/industrial use.

Parcels can be rezoned but it has to be brought in front of the planning and zoning committee for the county/town which the parcel is located and they have their own rules and fees to do so. Call your local planning and zoning office to get more details.

Obviously the zoning of parcels is specific to the overall land usage with each county and city. To change zoning you apply to the city and/or county if it borders a county road. It's not that it's difficult, as much as time consuming and you don't always get what you want. You would have to seek answer about what is or isn't allowed on specific parcels by contacting the city and/or county .

depends on the type business -- fruit stand vs. walmart....check w/ your local zoning dept. zoning can be changed, but depends for what, by whom & it can be a long process....you may be ok w/ a dogpark on ag land due to animals being allowed -- but you still need to check it out. if local zoning says yes, get it in writing. if they say no, ask why & if there can be an "exemption" or "variance" because of animals being ok on agland.

JB pretty much has it right.

You usually can't change the zoning on a specific piece of property. It would defeat the purpose of "Zoning", which is to designate certain areas for certain purposes (You wouldn't want a subdivision next door to a refinery, or a chemical plant next door to a farmers crops).

BUT, check the SPECIFICS of the zoning laws and see what is classisifed as what. Apartments are BOTH Residential and Business. Grocery stores, gas stations, and restaurants are Businesses, yet may be allowed in certain parts of Residential zones for convenience.

In order to get Zones changed You would have to submit the request to the local land-management/planning office/City or town council, who would ask for a VALID reason ("Because I want to." is NOT a VALID reason) for the change, and would probably take several years to study the "environmetal and social-economical impact" of your recommeded change to the Zones.

Before you purchase the land, you should look into zoning changes. In my area, land with a particular designation cannot receive a zoning change as the Urban Plan says there isn't enough land with that designation.

Often, it becomes more complex than residential, commercial and agricultural. My county has over 100 pages of zoning regulations and what land uses are permitted. You will want to talk to someone at your local planning department about your plan, and see what zoning designations will work for your dog park.
