Call the police. If you own the home, you have the right to evict him.

You'll have to initiate formal eviction proceedings.

The cops won't and can't do a thing unless an actual crime is being committed. This isn't a crimminal issue, it's strictly civil so there is nothing that the police can do. Of course, if the reason you want him out is due to crimminal activity (drugs, etc.) then by all means, call the cops. Do keep in mind that if he makes bail, he DOES have a legal right to return to your home as it's also HIS home.

Depending upon state law and local procedures, it can take anywhere from 30 to 90 days to complete an eviction. At the very least you need to serve him with a "notice to quit" and you won't be able to file eviction proceedings until you have done that.

If you're not on the ball with eviction procedures, a consultation with an attorney may be in order.

A few folks have suggested DIY evictions -- putting his property out of the house, changing the locks, etc. -- don't even THINK of this without legal advice first! Depending upon the laws in your state, you may leave yourself in a world of DEEP doo-doo with that! In many states, a DIY eviction is a CRIMMINAL act that can land YOU in jail.

You will have to give a written 30-day eviction notice to keep it legal. The only quicker way is if someone hasn't paid their rent on time and you can then issue a 10-day eviction notice , it has to be written. But also you might want to look into your housing laws in GA. Try this website:

Check local statutes first. If he comes home and finds the locks have been changed and his stuff out on the street without any legal notice (just telling him does not hold up in court), he has legal grounds to sue you.

Most places you can just mail him a return receipt/ certified letter through the post office saying he has 30 days to move out; that should suffice. Also, the Post office holds this info as record for about a month, if not a little longer (I think 3?) If by then he does not abide you call the sherriff's office (being the home owner you can do this) and have him removed from the premises.

When my cousins roomate didnt leave she called the local police dept. and had them assist the roomate on leaving ,also advised them to change the locks soon as they do leave. Good Luck

You need to give them a notarized notice of eviction, I think the minimum is two weeks in advance.

ask the person leave volunterily. Then find faults... the best thing to do is to try and help the person with his/her faults....Stay out of the persons way..


This is a short live, we need to make sure that the persons we meet we try and impart our positive values and take the same from them and have them help you with thei faults.

Completely change the locks and then call the police to escort them to get their stuff off of your front yard.

Move all of their stuff out while they're gone (like into the yard or something) then change the locks. ....that is if you've already asked them to leave and they wont. I sooo hate when people overstay their stinking welcomes!!! GAH!
