It depends on where you are in NY and if your apartment is rent controlled or not.
Just because it is in your lease does not make it legal.
In NY, late fees are permissible for residential leases as long as they are reasonable. Reasonable is usually considered to be somewhere in the neighborhood of 5% of your gross rent. That means if your rent is $500, a "reasonable" late fee would be $25.
You can refuse to pay and let a judge decide if it is reasonable or not. |

they can charge you an extra months rent if they so choose. i know someone who ended up losing their first last and security by not paying on the first of the month and there was nothing to be done about it this person actually discovered in the lease the rent was to be paid before the first of each month so read very carefully the small print befor signing the lease yes it is true BEFORE THE FIRST OF THE MONTH |
