What is the landlord responsible for and what do I have to do?
I came home to a flooded apartment yesterday due to the fact that they were cleaning the apt. above me since the lady moved out. The washer machine up there was broken and it flooded my whole apt except the dining room. My mattress is soaked throughout shoes and everything on the closet floor. and the electrical sockets well i'm sure you get the point. The landlord put us up in a hotel for a few days. I don't have renters insurance,....so what happens now he said the dryers in the apt will dry the matttress but i think it will be gross of what could have been in the water. what about mold they are striping and repaintin the walls will that eliminate mold growth. I am just in shock and my wedding is in 10weeks with so much more planning to do.
Additional Details
the people who did it were just the cleaners getting the unit ready for someone else but they too were the landlords adult children who did it on accident. The only major damage on my things is my mattress everything else can be washed or wiped off. But I guess i'm wondering is mold going to be an issue. I've resided in a apt before where i was wiping mold off the walls with bleach and water every week until finally i had to move because i didn't want my toddler to get sick. They are replacing all the carpet and repainting the ceiling and walls but i don't think that will do the job.

You have to ask someone who does landlord/tenant law in your state. Look at the ad displays under 'attorneys' or 'lawyers' in the yellow pages. In general, the landlord has liability, but you might have to sue him/her/the company to get the money.

The landlord will be responsible for any damages to his own property. Anything that is yours should be covered with renters insurance, Tenant's are foolish not to carry it.

Contrary to what others have posted...the landlord is only responsible for his property. Your personal belongings are your responsibility. Renters Insurance would have covered your losses. You may have a claim against the upstairs tenant..since it was her negligence that cause the damage...but not the landlord.

the landlord is liable for ALL your damages!!!
Ask him to pay, else take him to small claims....
HE HAS insurance....

Don't let the landlord give you any song and dance, they are responsible for all your damage, they caused the problem. The landlord has to have insurance for the building that covers this type of damage, it shouldn't be left up to you to have the insurance. It all depends on how much water the walls soaked up, but in must cases where the floors have been flooded,the floor up to 3 feet are removed to eliminate the problem of mold. They can strip and repaint the walls, but if water got inside of the walls, that striping and repainting isn't going to do any good providing the growth of mold. I don't know the complete story of the apartment and landlord, but I would say you need to look for another place to live. I know you probably have a 100 and one things going on with your wedding coming up, but you need to move to an apartment you feel comfortable in. From what you have said there isn't that much left to move, because everything has been damage. I hope before the landlord did anything you took pictures of the damage and condition of the apartment when you came home. If the landlord still pushes that you should have had insurance, list and cost out all the items that were damaged due to their act and take it to small claims court for reimbursement of replacement costs.

The landlord is responsible for the structure and some appliances. Renters insurance covers the rest. See if you can get a cheap temporary bed instead of sleeping on the moldy one and buy a new bed with your wedding gifts.

Check your lease and get legal help. Every state is different, you might have to pursue something in the courts to get $.

I think you should talk to them and try to get some kind of reimbursement for your destroyed property. To me, it seems that your destroyed property is a direct result of their negligence. It's not the kind of thing that I believe you should have to be responsible for. Check out your lease contract and it should detail that kind of stuff.

Your lease probably say you are responsible for your personal property. That's why there is renters' insurance.

Your only hope is that he knew the flood would probably happen and did absolutely nothing to prevent it.

Well we had kind of the same problem. If you didn't have renters insurance theres noting you can get. You could take them to court and try and prove neglance on their part, by not trying to keep the water from spreading. However this is a very weak case. May be you should contact a lawyer (with a free visit) to see about it. Nothing of ours was damaged except his carpet and pad. We were just out of that room for months while he tried to fix the problem
