What is the law on rent due dates and late fees?
I mean, they told us everyone's rent is due on the 5th day of each month. It is a $75 dollar late fee if rec'd after that. Isn't that a bit high? It was $40. And shouldn't we have a grace period from the stated due date? they're really pissin me off here...

ok we did have a lease, but the year was up just as the old owners went to sell the place and they didnt renew anyones lease. we're now on mo. to mo. and the lease says the 5th. thats is nothing more nothing less.

In NY,NJ,and PA there is no law stating when the rent is due, if there is a grace period or how much the landlord can charge as a late fee. All that needs to be spelled out in the lease. The exact date of the month that the rent is due, the exact date of the end of the grace period and the exact dollar amount of any fee for late charges all must be agreed upon signing the lease. The only time these things can be changed, legally, is either when the lease is renewed or, if you have a clause in you old lease that allows the landlord to change the terms of the lease agreement mid lease term

It sounds like you already have a grace period. Most rents are due on the first of the month with a grace period until the fifth, to allow mailing time.

Yeah, I would say whatever is in your lease goes. If you don't like it, you just have to discuss it or don't accept the lease. I've usually seen a $20 late fee, both with a grace period and without.

Not everything in life is flexible or negotiable. What do you expect? Stop complaining and learn some responsibility!

If you didn't agree with the rules, why did you sign the lease? You knew what was involved if the rent wasn't paid on time. Rent is due on the 1st....by accepting it through the 5th, there's your grace period! Stop taking advantage of it and be more responsible! You're probably pissing them off!

The company can do what they want. They are free to change it as long as they notify you with enough time. A grace period is a 50/50...some do it some don't. My apartment charges 10% late fee so it's almost 100 bucks. Tough breaks.

The rent is probably due on the 1st., but they give you until the 5th. Just drive them crazy back & pay early each month, like I did when I rented.

You signed a lease when you moved in, all of the fees should be included in that lease.

If there are any laws, they would be at the local or state level. But most places probably do not have any laws on this. Whatever you agreed to when you signed your lease is what you have to abide by.

It's doubtful they could increase it to $75 unless you signed a new lease or some agreement.

If you are on month to month, the old lease still holds-as long as you don't sign anything new.

Your rent due date is on the contract that you signed as well as the grace periods, fees, or anything else !
Unless you signed a new contract then your late fee can not be changed.
