late fees and such are stipulated in the lease agreement, I don't think there is a grace period law. |

its stipulated in ur lease if there is grace period and if so how many days. it would also detail what your late charges would be for late rent. in our buildings lease we give a 10 day grace period but it would say it in ur lease. if u need to post mark ur check for the 1st it usually take a few days for it to clear so u should be good. |

Not necessarily - it depends on what's in your lease. Many leases have a grace period written in. If yours doesn't, and it says it's due on the first, then it's late after that, and the landlord can most likely charge you a late fee. |

nope. i mean it could be, but you have to refer to your contract. this was true at my last apartment complex, but at the place i'm living at now if they don't have it in their possesion (postmarked or not) by the close of business the third day it's a $500 fine.

There isn't a "legal" grace period for post marking rent checks. Every rental agreement is different, therefore your landlord could impose a late charge if the check wasn't actually received (in hand) by the 5th. |
