What is the penalty for breaking a rental agreement?
Hello, I am a college student planning to go abroad next spring. Every lease I have looked at wants a 12 month agreement. I live in Minneapolis, MN and was wondering what sort of penalty I would face for breaking the lease early. Thanks in Advance.

It varies from landlord to landlord. Study the lease agreement. You will generally be required to pay rent on the premises until such time as the landlord or leasing agent is able to put more tenants in.

You may also be required to pay for advertising the premises for rent again and an administration fee.

Try your new college-level negotiating skills! Negotiate a lease with a term that suits you, not the landlord. If he wants your business, he can have it on a month-to-month basis, or a 6-month lease. This is truly not a big deal for the landlord to accept, so show a little backbone!

Your strongest card is to negotiate before the contract.

State and local laws govern tenant/landlord interaction. Generally a court would uphold a contract, so do not sign a contract that does not meet your needs.

Whatever agreement you come up with, make sure it is put into writing!

What is the penalty? The landlord will try to collect the rent while your unit is vacant. He might lie about when it was re-rented, too, so he'll go for the full amount. Without going to court, this can end up on your credit record as a debt owed and not paid.

You have a strong incentive to negotiate.

First when you look at the apt. explain that you will be graduating this month, this day and they will write the lease usually for that amount of time, they did it for my friends in AZ. If you break the lease early you are subject to being held responsibile for the unpaid monthly rent besides loosing deposits. Even if you find someone to rent out the rest of your lease too, they can report it as you defaulted on your agreement and have a black mark on your credit. There are ways to get out of them early BUT you need it specifically in writing AND you still have to give a written notice to the office when leaving even if you arranged it with someone before don't let them tell you its ok- GET it in WRITING- and make a copy of your letter when you give a 30 day notice with the persons name on who you delivered the letter to or send it certified mail so you have a signiture. Because the person you talked to and agreed to arrangements may have quit or got fired when its time for you to go and they claim they didn't know about the agreement which happened to my friend too.
Sometimes you can break a lease without too much hassle if your job has transfered you but you will have to show proof. Sit down and talk with the apt mgr before signing, explain everthing and don't forget to give a 30 day notice or more(depending what the lease papers state)

You should tell the owners/managers you are negotiating with that you are a student and need a lease that covers the academic year, if they are nearby college/university, they are probably familiar with this request.
Don't get into a lease you know you will have to break early, it will cost you money.

Well i live in London, UK & i think its the same in Australia so this will prob be the same in the US. When you start your agreement with your landlord they will ask for a deposit, normally one months rent & if you pull out thats all you lose. So as long as the rent per month isnt to high it might not be to bad pulling out early. I pay £1500 ($3000) per month in rent for my flat in London & i am on a 3 year agreement & because its longer i had to give a deposit if £9,000 ($20, 000)so its quite a bit more.

If I were you I would approach the landlord and ask them if you can be let out of your lease agreement early and if so what would it entail. Normally, in your rental agreement it should spell out the terms of early termination and from the ones I've read that usually means giving 90 days written notice. A lot of landlords are really decent especially if you're above board with them and if they know in advance they might let you out without penalty as long as they can find someone to take immediate occupancy.

It will go on your record in the renters database (yes, there really is one, they check it as part of your qualification check) and you will be responsible for the balance of the rent (no payment plan). Also, they can put it on your credit report if you don't pay that remaining balance when they ask for it.

It would depend on the lease you sign. Some state that if you terminate early you could be liable for the remaining time on the lease, some claim you forfeit your security deposit and are still responsible for the time remaining on the lease. It all depends, every lease is different each Landlord decides his own termination fee.

Most apartments now a days do short term rentals, you get the best rent on a 12 month lease but they will do short term like 6 months. See if you can do a 6 month and then go month to month afterwards then all you have to do is give 30 days notice to vacate.
