What kind of lawyer do I need to call about this?
My apartment has been roach ridden since Imoved into it.Over the past 2yrs I've tried everything to get rid ofthem but they keep coming back because the entire complex is roach ridden.My rent has been raised twice since I've moved in and the roach problem has never been taken care of.Do I haveto pay them rent?Or pay to get out of my contract?What kind of lawyer do I call about this?

Call a Real Estate attorney, but I would also call your local health department. Good luck!!!!

Look in the Yellow Pages... what an embarassment of an answer!

You don't need a lawyer right now. What you need to do is contact your local health inspector. If there is really a health issue, the Town is required to force the landlord to take action.

Do you have to pay them rent? Yes. Until you're told otherwise, absolutely... and you can be evicted very promptly if you fail to pay rent. The Town will act as your advocate if the issue is really as bad as you say it is. And if the Town determines that health codes are being violated, they will legally require that they take action to exterminate the roaches, and they will follow-up with them to make sure the issue is resolved. If they fail to resolve it within a set timeframe (usually as little as ten days), then they will be held liable, and the health director will advise you of your rights, including the right to not pay rent or exit the contract.

If they determine that there is no violation of the health codes, then you have no recourse.

If you fel that you must contact a lawyer, you need a property law attorney. They handle evictions, lease agreements, estates, and so forth. But your municipal health director is your first line of defense.

Went through the same problem a few years ago. Find a Real Estate Lawyer and contact the local housing inspector. The inspector here put the pressure on the Land Lord to get it fixed or go to court and the problem got fixed right away.

You are going to have to pay rent no matter what. Even though it is a bad situation, that is not an excuse to not pay rent. What have they done to fix the situation? Have they made reasonable attempts on their end? Try calling their management company and make them aware of the situation and see if there is a way to break your lease. They may have raised your rent, but it is your choice to keep signing new leases.

A lwayer is going to cost you money. These government agencies can help you at no charge.

Roaches are just a fact of life in some apartment complexes especially those in larger cities.... once they come in, it is ALMOST impossible to rid yourself of them on a permanent basis... because the entire complex would have to be fumagated all at ONCE in order to do it ... exterminators who go from one apartment to the next just push the little critters to other apartments until their spraying is over and within HOURS, they just hop right back into YOUR freshly "sprayed" apartment. Knowing this, you've still stayed in your place for at LEAST 2 YEARS????? How long a lease did you sign anyway? Usually they only go for a year at a time!!!! So, you have roaches---sorry but that is NOT enough of a problem to be able to break your lease..if it were, then NO one would be living in those apartments. That said, there is really no reason to waste your money on a lawyer because they won't help you.......Oh and when you DO finally decide to rid yourself of the ROACH MOTEL you live in----be VERY CAREFUL because roaches tend to hide INSIDE things that you might be moving into a new place and then they just hop right off and start being fruitful and multiplying all over your NEW apartment...check everything and check it again before it goes into a moving truck or car.

Before an attorney, you could try to call your City or County - it may be the complex isn't keeping up to standards required by the City or County. Also look for something like "Fair Housing" in phone book - an organization that tells you exactly what your rights are (for free) and how to proceed.

my dad's a lawyer. but he's a work right now so I suggest you talk to your landlord about the roaches. If you think that's not enough, google, look in the newspaper, or look in the yellow pages for a lawyer. He or she will probably have a description on what they can help you with.
