My landlord rented us a house, with a in law trailer, and detached garage. We could live in trailer for free while we did repairs on trailer and home, and my husband would get paid hourly. We made all necessary repairs on trailer. I obtained custody of my other child, and landlord decides he doesnt want us to move into home because the home is "uninhabitable" and he doesnt want the courts around here. Now he gave us 30 days verbal to vacate, and wont return the security deposit back on the "house" we never moved into. He also wont pay us for all of the repairs. It seems he scammed us from the beginning. Everything is documented in e-mails. This guy is wacko, even has cameras watching our every move, on every corner of every building. We have only been here 2 months, now we are forced to move, after we made EXTENSIVE repairs. We cant get our sec dep back even tho we never signed a lease or even moved into the home. He told us he got the letter that his house was uninhabitable BEFORE we moved in, but he didnt think it was a bad idea until now. Wouldnt you think we had MAJOR legal recourse against this guy? Thanks all for your answers. Additional Details Also, if it wasnt clear when I wrote the question earlier, we NEVER received a dime for any of the repairs made, and we were only supposed to live in the trailer RENT free until we moved into the home. The reason for this was it is 2 adults, 2 opposite sex children(6 and 8) 2 dogs, and 4 cats in a TINY 2 bedroom trailer. It was only supposed to be temporary, from the e-mails, it shouldnt have been more then 4weeks in the trailer. So we never received anything fro the landlord, but we laid all new flooring(carpet and vinyl through out the entire trailer). We spent one week mowing the 3 ft tall grass, and repairing our lawn mower 3 times from the damage, we took down a 20 ft antenna attached to the home as asked by the landlord, and we built a fence that he requested, and even purchased the materials ourselves. We spent 2 weeks alone cleaning up the property(grass, cutting trees, cleaning trass, etc.) |

Well you lived in the trailer rent free and also got paid for the repairs at an hourly rate. I feel like you got a great deal on that. I'm sure the courts would look at the security deposit as one for the trailer not the house. He is well with in his rights especially since you didn't have a lease. The camera thing is totally legal so that point is moot. Sorry |

You can try. None of the verbal or email agreements are admissible in court though. Other then no signatures, emails can be forged in seconds, my 7 year old could easily do it. They can not be used. Only your written contract.
You will have to convince the judge a landlord agreed to not only let you stay for free, but he was going to pay you for the privilege. That wil be tough to prove as it is not very logical.
You only have "MAJOR legal recourse against this guy" if you suffered major loss and you can prove that you did. You should get money back from purchasing the carpet and vinyl, as well as fence materials. You will not collect on repairing your things, and you may not collect on the labor fees, as you have no contract to pay you in the first place and he can easily convince the judge that you were living for free in exchange for labor (common agreement). |

Get a lawyer. This is a pretty good case for discrimination, harrassment, and fraud. You're right---he's a wacko, and it's a good thing you have documented this process or you would not have any recourse. |

you have 2 separate issues here.
Issue #1. Renting
You have no written lease. All you have is a verbal agreement, which by law is a month-to-month lease. This means that the landlord has no obligations to provide you with the house. You have a month-to-month lease on the trailer, and the house is irrelevant. The landlord has no obligation to let you move into the house.
Based on the verbal month to month agreement (legally speaking) he must give you 30 days notice if he wants you to move out of the trailer. If you don't move out within the 30 day period, he can evict you.
Issue #2: Repairs to the house.
You had a verbal agreement with him about doing repairs in exchange for pay. The emails will help a little in court, but not much, since emails are so easily forged.
You can take him to small claims court and sue for labor and material for the work you did. I hope you have some evidence such as before and after pictures, time logs of your time spent, and receipts from the materials you purchase.
Without a written contract your case is weak, but you could still win.
Let this experience serve as some lessons for you:
1. Get everything in writing.
2. Never pay up front out of your own pocket.
3. Never get too far ahead on services before you collect payment. If you've done $500 worth of work, don't do anymore work until you get paid $500. |

I suspect that you don't have a valid signed lease. If you do have emails that cover what you stated then you probably do have a case. If you can afford an attorney then get one. If you can't afford one then try Legal Aid. You could also go to the court house and ask them what your rights are. They can be very helpful. My wife and I had rented out our old home and the court told us what we could do to be awarded damages when they tore it up. |

if you have it documented in email all that was agreed upon that is considered a legal binding contract between the two of two. he can ask you to leave, he has the right. but if it is agreed for the repairs in writing that payment would be given, and a security deposit on a home you never lived in must be returned unless you backed out of an agreement. since he backed out security deposits must be returned. you could easily file a suit against him. |

I know you are upset and want to get something back from this guy but is it worth the effort. It might be better to just walk away and start over if this guy is that crazy. I would call the police and file a complaint against this guy. He may have no right to be recording you and if they investigate they may find out that he is up to something else. He sounds like bad news and I would get away from him. |

if its in emails yes.. and that he knew it was uninhabitable before u moved in and didnt tell u.. honestly i would go on one of the tv courts.. only because.. i been to court for several things and it seems with the tv one they want to hear what you have to say in county courts they just brush it off... call im serious.. put this guy out there.. you will get the deposit back and tell the court the deal and know hes just being a jerk. good luck do this asap ... with tv court u would be there in like 1 week..
