My mom is a tenant in Brooklyn, NY. Despite repeated requests, the landlord will not provide heat in the building. This is one of his many antics to push the tenants out, as it is his intention to force them out because he wants to sell the building. He has not fixed the locks on the main entrance for over a year now and twice, strangers have walked uninvited into the premises. Are there any organizations that will help, will the courts do anything, and is he open to a lawsuit as a result? Additional Details Can he be sued for "pain and suffering"? |

If some soreof lease or contract was signed then you entered into a Tenant-Landlord agreement and with that come certain rules. The landlord has a contractual obligation to make sure that the utilities, including heat, is working. This is one set of the rules the landlord must follow.
My reccomendation would be to call the police to file a report. When you call, tell them that after repeated requests the landlord refuses to fix the heat. The landlord may get a summons to court. The cops probably won't blow you off, and in any case the incident will be recorded on tape and on paper. (I'm not sure how it works in NY).
Then seek free legal help. Look for something under pro bono. The tenants all together represent a class. They can sue the landlord as a group. The court could force the landlord to fix the problems, send the landlord to jail, or something along those lines. |

Above all else, document everything. Pictures, call unwanted guests into the police and get a report, send a certified letter to request the locks be fixed, get a quote for repairs, film if needed. Regardless of the agencies involved, you will need to document your landlords activities as validation of your good faith responses to get him to do something. Otherwise, this will be a her said she said response, probably favoring the landlord. So get the proof and give it to the agencies you contact. |

That is illegal, she shouldn't go one more day without heat. Try the Local Consumer Commission also, The place is supposed to be secured or safe for living, you can call the police and file a report, keep a log of everything that has happened, could be useful in the future. Good luck. |
