You have most of the same rights as a month to month renter. The 30 days notice is appropriate, although some states require less.

I cant believe the answers on this one!!

The Tenant does have rights - if the landlord has allowed the tenant into the property and has accepted payment (ie rent) for the occupation, that by legal definition is a contract. It doesn't matter that it is not in writing. The Tenant has a legal right to remain in the property and pretty much has the same rights as someone with a tenancy agreement. The Landlord, by Law, has to give two months notice in writing if he wants the tenant to vacate, just like he would any other tenant.

If it was the tenant wishing to vacate I would say they could give just one months notice without too much trouble - the landlord should have no grounds for complaint as he should have got the tenancy agreement in writing.

Depends on the nature of the property.

If you're a lodger, then you don't really have any.

If you are renting a flat or a house, then you have loads of rights. In fact, without an assured shorthold agreement, you could be a sitting tenant, and therefore have the right to remain there for life (provided you don't default on rent etc).

To everyone who has said "none", they are 100% wrong. Everyone has rights, regardless of the circumtances.

And yes, you can give one months notice. That's fine.

Each state, USA, has statute on landlord tenant law so yes you have those rights outlines by your state statute, each state is a little different on some of the rights granted under statute

Under state statute I believe all states will find you to be a month to month if no written agreement, under that each party may give a month notice to end the lease , i think GA is 2 months , and NJ is a just cause so way different answer

You have no rights at all, and you should always have a written tennancy agreement. Your landlord can ask you to leave at any time, he can even say you shouldnt even be there, he could say you are sqaTTING, HE CAN SAY ANYTHING, IF YOU HAVE NO PROOF, WHAT CAN YOU DO!

legal terms you have to give one months notice, but because you have no agreement, i guess you can leave when ever!! unless your on a rolling contract with your landlord! you need to find out why you haven't got a tenancy agreement as its against the law!

Go to citizens advice they are really helpful because i was in the same situation a few years ago and found out that they couldn't just throw me out without at least a months notice unless you have broken the law or they think you are using the tenancy for illegal purposes

with no signed lease you are a tenant at will. Which means you can live there with the LL's permission but you have no rights, the LL only has to give you 30 days notice to vacate and can up the rent at will. You have to give only 30 notice to vacate.

If you don't have a lease, it doesn't matter how long you have lived there. 30 days is the law with giving notice on both parties sides.

Tenancy is defined in each state premised on that state's landlord tenant act however all states define a tenancy without a lease. If you have occupied the premises by permission you are the tenant of the person on the lease and they are the landlord as opposed to that person being the tenant of the owner of the premises who is their landlord. If the tenant of the owner has the right to grant a sublease then the tenant of the tenant(landlord) is indeed a tenant if on the other hand you are occupying without permission or the tenant (landlord) does not have the ability to sublease then you are a tenant holding over without permission but still a tenant. Your tenancy is a month to month tenancy and as such the state landlord tenant act will require you to provide to your landlord a 30 day notice to vacate the premises after the payment of the rent due is made.
