What should I do about apartment security deposit?
I've been out of my apartment in upstate ny for 2 wks now, and I finally received my security deposit back, or a small part of it!! I put down $300 security deposit and only received a money order for $88 back. This apartment was a small 1 room studio about 20 x 30 ft in size. When i leftr i cleaned the place for about 2hrs and even rinse n vacced the carpet , With the $ 88 money order I received today was an itemized bill of cost to clean the apartment,@$25 an hour for 7.5 hrs=$186 plus $8 for new drip pans and $15 for the broiler for a total of $212 .That I didn't get back. In the rental agreement it states that the security deposit is for damage. and there was no damage to the apartment. What should I do?

If the drip pans and broiler were missing or damaged, you are liable for replacing them. You have a legal right to see a receipt documenting the price of replacement. If they were never present, you can protest on those grounds.

You may be able to protest the cleaning charge. Unless the cleaning service was itemized in your lease agreement, many areas require a receipt from a cleaning service proving that the apartment was cleaned and the price charged. Frequently a landlord charging a specific price for cleaning themselves is not sufficient. Unfortunately, cleaning is a very subjective topic. Hate to burst your bubble, but, your clean may be your landlord's pigsty, and it is hard to say on whose side a judge would sway.

My suggestion is next time take an inventory and pictures when you move in and move out. A picture truly is a thousand words.

You needed to actually have done some things before to ensure that you actually got back your security deposit. If you didn't it can make things that much more difficult to get back your deposit. However we think you should take the landlord to small claims court. When you leave an appartment, it has to be "rent ready" or else they ll charge you for the cleaning, if you live more than a year, well, they may not be so fussy, but 2 hours is not too much to clean a place but anyway, if you feel it is unfair, you may take the owner to small claims court for the balance, you may or may not win, but you tried your best. Only hearing your side of the story, so I'll say you could take them to small claims court to dispute the costs. If it took 7.5 hours to clean that place then it must be clean enough to eat off the floors now...but you got off pretty cheap with only $23 for the drip pans and broiler - just think of how many hours they could have spent cleaning them!
Late now, but in the future, when you move out of an apartment, take pictures of how you leave it - be sure to include that days newspaper in the pictures (timestamps aren't actually valid because the date could be set to what you want it to show).

Talk to the landlord. If you don't get anywhere, complain again. I work in this business and I know we sometimes pay people a small refund just to get rid of them. We're only human. You can take it to small claims court if you have the time but it might not be worth the trouble. Although the judge usually sides with the individual more than the company.

didn't take photos of the place BEFORE you left it? No proof that you did ANYTHING to "clean" the apartment before you left? Oh well. ALWAYS ALWAYS ALWAYS take PHOTOS of every room in an apartment just prior to your vacating so that you ALWAYS have proof of how you left a place... Without proof, you can't really do much of anything---it would be YOUR word against the landlords and in those cases the landlord USUALLY wins...

You should have left the place broom clean. Broom clean is as clean as can be after sweeping with a broom.
You probably should not have been charged for cleaning.

You can sue your landlord. You are not responsible for normal wear and tear.

Give the landlord something to worry about.

you can take them to small claims court to get your money back, just filing may get them to move. let them explain it to the judge you have a contract and you cleaned the place.
