What should I say to landlord?
Okay so I just recently moved into a home that I am currently renting. I moved in on Oct 11th. I live on the east side of USA so Its been chilly and the heat is broken, I have a small child and a single heater so we have to stay in one room to stay warm for now, my landlord has been out several times to fix the problem and has not done so yet.

MY QUESTION IS: Rent is due on 11/7 and I do not feel as though I should have to pay the full amount if I haven't had any heat and it's been an inconvenience. So how do I approach my landlord about this matter?? And also if they fix it before rent is due, should I STILL have to pay the full amount of rent on due date?

Yes, just because your landlord hasn't fixed something you are still legally required to pay him rent in full, failure to do so can get you evicted.

By law the Landlord is required to provide you with heat, it's a necessicity, I suggest you notify him in writing [always in writing] send certified or FedEx [you need proof of delivery] that the heat is broken, the issue hasn't been fixed and if he does not fix the problem by such and such a date [14 days from receipt of letter] that you will look to escrow your rent with the courts. Make sure you can do that first before making that statement.

It would help if I knew what state you are in. Since you haven't listed it go to the web and type "tenant landlord law and your state" and it'll bring up landlord obligations and yours and what your remedies are if maintenance is not done timely or at all.

Most states do not allow a tenant to withhold rent without a court order or permission from the county clerk to place rent in a supervised escrow account. Unless you are forced to move into other housing due to the temp. of the apartment, you are not entitled to a rent reduction.

Check your local laws, Heat is considered a necessary amenity and most states require the landlord to fix the heat within 48-72 hours after you report that it is broken. I would find the local laws on this and if your landlord is not living up to his legal requirements, then threaten a lawsuit and/or threaten to break your lease and move out.

You owe the rent.
Talk to your landlord. If he has been out several times, did he tell you what was going on?
After hearing him out, give him a date certain he will have the heat in working order or you will need to make other arrangements and expect a full refund of any deposits. Then MAIL him a note to the same effect KEEPING a copy and PROOF of mailing. Close the note with, "I want to stay and be a good tenant, so please let me know your plans and have the heat in safe and good working order by xx/xx/xxxx.(the date certain you gave for repair).

State law dictates how much time a landlord has to fix problems like no heat....it is a very short amount of time.... as long as you lawfully notified him....in writing....return receipt requested...
State law also says when you can or cannot withhold rent....tread very carefully here..

google your state and landlord/tenant laws.

FIrst, you are contradicting yourself. One sentance states "no heat" and another "single heater".

The law only requires one heater. You will not get anywhere complaining about the landlord following the law.

Rent is due 11/7, I suggest you pay it. An eviction will make it very hard for you to ever rent in a decent area again, and the ghetto is no where to raise a kid.

Buy yourself a room heater, I even use one with central heat to have one room warmer then the rest of the house.

Pay your rent on time or he will find a way to evict you. It sounds like he is trying to get the repairs done.

YOU CANNOT WITHHOLD RENT FOR THINGS NEEDING TO BE FIXED! This is illegal and you will be evicted. Landlords are under no obligation to give any discounts for repairs either.

If they have been out several times already, then it sounds like they are doing what they can to fix the problem. Some repairs take a couple trips of trying things to figure out what is wrong. It would be a bigger issue if they were ignoring you and not doing anything to try to fix it.

Talk to your landlord. Find out the status of the repairs and make sure they understand the full extent of the issue. I know that not having enough heat is a big problem, but you need to give him time to get it fixed.

EDIT: Those telling you to threaten your landlord are not being fair. Those measures are intended for landlords that flat out refuse to fix things. Not ones that are trying to get it working for you.

I agree with another poster that said that you DO have some heat so those legal actions recomeded may not work anyway.

You still have to make your payment so that you are still honoring the contract. They are the ones breaking it if repairs are not being done. Simply call the local housing authority to complain (Urban League or simply call the city and they'll direct you to the right people).

You may not withhold rent. But not having heat is a habitability issue. You need to notify the landlord in writing that they have 72 hours to correct the problem. If they do not then find a good attorney, or contact your local landlords governing body for advice and to report the issue.

Do not mix rent and Maintenance. If you feel like that go to your local Court House and place rent in escrow and file a court proceeding in Landlord Tenant court to negotiate the discount with your landlord and the judge.
