This is the law for NYC; I couldn't find specifics for Westchester. However, there is a basic "habitability" law that landlords must abide by.
Heat must be supplied from October 1 through May 31, to tenants in multiple dwellings if: a) the outdoor temperature falls below 55 degrees Fahrenheit, between 6 A.M. and 10 P.M., each apartment must be heated to a temperature of at least 68 degrees Fahrenheit; (b) the outdoor temperature falls below 40 degrees Fahrenheit, between the hours of 10 P.M. and 6 A.M., each apartment must be heated to a temperature of at least 55 degrees Fahrenheit. (Multiple Dwelling Law § 79) |

Is there a rent control board in Westchester? Contact them. If not, call your board of supervisors and ask to speak to someone about a critical matter. Try calling your local representative's office, too. They can certainly direct you to the appropriate person to help.

You need to find the rental laws for your state and see what they say in a case like this. Usually states provide their statues (rules and regulations) on a website, so you should be able to research it rather quickly. Also, since your landlord is not providing a "habitable" apartment you can cut the rent by a certain percentage. If you reduce the rent and notify the landlord of the breach in contract, you should be able to terminate the rental agreement without penalty to you. If anything is unclear you should seek professional help, someone that is familiar with the laws and regulations of your state. Good luck!!! |

Write a letter to your landlord, get it notarized (you can get a letter notarized at a bank) keep a copy for yourself and send it to your landlord. I forget what it's called, but there's a way to send a letter and to have the landlord sign when he recieves it. Call your post office to ask what it is called. It would also help to account how many times you have asked him to fix the problem, also if you have gotten sick because of it, etc. If he doesn't follow through with the heating problem, you can take him to court. You will win. |

I am unsure of the laws in New York, but in Ontario, Canada there is a law that states that it is the responsibilty of the landlord to make the unit in a livable state- I believe that this would include heat.
I would advise search for your landlord and tenant rights through a government website- they might even be a site just for landlord and tenant matters. These sites will usually tell you your rights as a tenant. If you still cannot find anything, I would suggest speaking to an agent ( either a lawyer or paralegal) and they can aid you on how to get that heat on again. |

excluding knowing NY landlord tenant law, all the rest of the states
are simple about this;
a connection to water, electricity, gas and heat and cold are
required by law. I will PRESUME the same is with NY.
if so, the law says you must give him 5 days notice and then
you may leave the unit, under what is called a "CONSTRUCTIVE
EVICTION." You are being evicted because the unit is
not as the law requires it to be.
