What to do? My landlord claims that I did not pay my April rent, but I did?
I got notice of non payment today and it claims that I did not pay the April rent. But they are mistaken, I did pay the rent and I have a copy of the check I wrote them. However, I don't have a receipt of payment. they don't usually gave out receipts.
So I showed them my copy of the check, but they claim it proves nothing and still want me to pay the rent. I guess they lost my check or something.
Is it my responsibility? Do I have to write them another check? How are they responsible for my previous check I wrote them?

First confirm with your bank that your landlord did not cash the check.

If this is the case, then cancel the check with your bank. Then write a new check to the landlord. I would request the landlord credit the bank charge for canceling the check (since they lost it) to your rent so you can write the new check for a lesser amount.

Your bank should be able to research, for a fee, who cashed the check you wrote and on what day. They should be able to give you a copy of the info.

A copy of the cabcelled check should be proof. Get a copy and take it to the office.

They are right a copy of a check proves nothing. Have your bank pull your checks in that amount. Every check for say 1,100 dollars (no clue what your rent is). It will take the bank about 30 seconds to have all the checks that you have written to your landlord since you have been there.

Just get a copy of the cancelled check. But I would think you would know from your balance if they cashed it or not. If the check has not been cashed put a stop payment on it. Cost like 10 bucks and give them a new check. Good luck but call the bank and offer your landlord proof.

I would check with your bank to see if the check ever was cashed if not cancel that check and write a new one to your butt head landlord.......good luck!!!

Get a certified copy of the check (front and back) from your bank that shows it was cashed by the landlord. Some banks even allow you to do this online.

This should settle the matter.

You need two things, so that you don't have to pay them.

1st copy of the canceled check
2nd copy of bank statement were the money was taken out of the account.

If they never cashed the check, then you need to cancel the 1st one and write them a 2nd one. Now in their eyes you are late paying, regardles of the situation, if they want to charge you a fee and this is the 1st time it has happened, then ask for a 1 time consideration of any late fees.

Check with your bank to see if the check cleared your account yet. If it did you can get a copy of the back of the check showing their account information on it, and that it did clear their bank account. If it has not cleared your account then you may have to issue a stop payment on the check and reissue them a new check. I would start demanding a receipt from them every month to make sure that you don't get stuck like this again in the future.

Confirm with YOUR bacnk the check was not presented for payment.

If it has, you can request a copy of that check.

IF NOT, stop payment on that check and pay the landlord - with the late charge.

I had the same thing happen with my landlord. I asked about and started using my credit union's money orders. At the time of purchase, I was given a copy.

When I paid the rent, I ALWAYS included a letter referncing that month's money order number.

A VERY strange thing happened! No more missing rent!

You need to go to your bank and make sure your landlord cashed it. If it has been cashed, then you should be able to get a copy of the check, both front and back. If your landlord signed and cashed the check, then do not write another check to him.

If the check has not been cashed, then cancel the other check and write your landlord another check, but you should not have to pay late charges since you did write a check for your rent already.

Pull out all your checks. If you've been there 8 months you should be able to produce copies of 8 checks. You should not have to pay again for their clerical error.
