What to do when you buy a house in San Francisco and the renter does not move?I have that problem.?
My daughter bought a house in San Francisco with a renter living in it at the time, now she is facing a horrible dilema in trying to evict her out of the house, in the mean time she has to pay the morgage every month, while the renter pays a very small amount. She already contacted a lawyer but he tells her that she has to pay her to move. Is this fair?

Unfortunately, while not fair, the law usually favors the tenant. Has your daughter offered her anything to move? That might be the only way. Or court?? Good luck to you both.

First off, what kind of contract did the tenant have with the last owner, what does your mortgage contract say about the tenant, usually if the home is getting sold the "tenant" has so many days to move. Reread everything carefully, then IF your mortgage contract says tenant living in dwelling must be out by, it is phrased differant I am sure, then get the police and an eviction notice and go from there.

Good luck, this can be a very hard problem to solve!

OH and as the new landlord YOU can jack up the rent!

I spent 15 years living in the soviet socialist state of San Francisco. I purchased a home there that had renters, but they did not put up a fight as your daughters tenant has. I'm afraid capitalism means nothing in lovely san francisco and that your daughter is screwed. She should have know this going in and her real estate agent should have made her well aware of the potential problems. I'd try to sue the real estate agent for not disclosing the situation.

California has some very, very tenant friendly laws that basically favor that tenant over your daughter. Tenants cannot be evicted, nor can they be made to pay market level rent. It's ridiculous.

You are probably using the San Francisco Ellis Act to evict the tenant, which states that the building is now being removed from the rental market. Last year this law was ruled to be legal by the California Court of Appeals.

The rule states, unfortunately, that you have to give 120 days' notice, plus pay a relocation benefit to each tenant.

I know, it sucks for the new owner, but this rule was put into place because of the tremendous amount of real estate speculators who would buy a building, say they were moving in, evict everyone who was paying a nice low rental rate, then jack the rental prices up, sometimes triple or quadruple, and re-rent it.

SF has strong tenant laws. It's hard to evict, and it's hard to raise rent except in small increments.

She needs to read the lease and see what the terms are regarding termination. The lease may say that she has to help the tenant move out. Or it may allow her to give written notice and then have the locks changed and forcibly evict the tenant if they refuse to move out.

Ask to see her lease. If she can not provide it then you might have a chance. Most times a lease will have a claus in it regarding the sale of the property. The laws in Florida are differant but they favor the landlord more than the tenant. Check the Internet for the Landlord Tenant Act of California. This would be a good start.

The person is in possession of the property as a tenant under the terms of a contract with the former owner. You'll need to check your sales contract but usually when one purchases a concern (be it a house, a business, a car) the buyer assumes all existing liabilities and assets associated with the property. Thus, if it is not specifically spelled out in the sales contract that the tenant's lease expires at sale (and it must also say this in the tenant's lease) then you are stuck.

The first stop is to contact the seller and obtain a copy of the tenant's lease. Your next step will depend on that that document says.

Notify this tenant that the police will escort her out if she refuses to leave. Is there some sort of contract, lease or something? If not, go for it.

I'm far from an expert but I thinking it would depend on the rental agreement the tenant had with the previous owner. If they had a term lease agreement that has not yet expired then you might be out luck. However, once the term is over you can decide not to re-new the agreement. I know that there are clauses in some rental agreements that basically void the rental agreement in the event of the sale of the property.
