What to do with my council flat?
I have a council flat. But i want to live with other students while at university and possibly do a placement abroad for a few months if i can. I feel tied to it and you arnt allowed to sub let even for a month. It took me 5 years to get it and if i just leave i may need it in the future.as affordable flats arnt easy to come by. Any ideas i feel a very trapped ?

The judgemental answers are not appreaciated at all as you may be housing officers but you do not know my personal circumstances at all and have no right to stand on your outsider "no personal experience in my situation"soap box and preach. If you've your own council flat, why on earth would you want to live with a bunch of students?

It would be cheaper and healthier for you to roll about in sewage and go to live on a rubbish tip.

If you go abroad, just get someone to house-sit for you. People trapped in a shared house with students would love such an opportunity.

As far as i know you cannot let out your council home unless you are in the process of buying. If you leave without the proper notice etc. you could be classed as making yourself homeless and the local authority have no obligation to re-house you.
If you put someone else on the 'rent book' and they don't pay, or are anti social you are liable for rent and could be evicted for persistant ASB.
If you have no plans to stay there continuously wouldn't it be better to let someone else have it? After Uni you'll be off into the world and having fun.

Check with the Citizens Advice Bureau.

Why do'nt you try for an exchange with someone in the area you are going to be a student in?You can also exchange homes with people overseas through "homeswaps" when you do your placement. Lots of alternatives.

Interesting question. If you could afford to buy your flat under the RTB scheme and became a leaseholder, generally such long leases do not limit sub-letting at all, at most asking for a notice which is rarely enforced, that the property is sublet. There is rarely a limit on the period of such letting. Bu may be cant afford it.

You should check your secure tenancy terms as you may be able to have one or more lodgers - depending on the flat size and pop back from time to time, ie weekly. Provided they are genuinely sharing with you, no locks on doors etc and you pay all the bills this is about as far as you can go without losing the flat. You also need to keep your neighbours sweet as the 'grassing' will most likely be from disgruntled residents.

You could try to swop your flat to another nearer where you are studying and get your 'student lodgers' to join you there.

I would NOT give it up as secure tenancy rents are about 50% of what tenants in the real world have to pay ! However if you do, look out for the schemes where Councils and housing associations offer you money towards buying a private house/ flat or simply cash to get out. It was a dodgy tactic private sector 'winklers' used to use in the 1970's to get regulated tenants out, but somehow its now respectable when used by councils... !

As a worker for a local housing authority, I would say that the council would not allow you to sub-let your flat.You cannot have your cake and eat it, you are damned lucky to be given a council flat. Make your mind up, your friends or your council flat? There are a billion people desperate for affordable housing,and the situation is getting worse, and don't think you will get away with sub-letting without permission,if you get caught you will be evicted anyway!

Your tenancy agreement probably says that you have to live in it for a certain percentage of the time, and if you are likely to be away from it for a while you should let your landlords know.

Whilst you are away for the next three years your flat could be rented out to someone with a genuine need for it and not just someone who'll want it in a few years time. The housing lists are phenomenal with demand being extraordinarily high and supply being very low!

This is a very "grey" area with regards to renting from the council. It all depends on the council policy in your area. You will need to check it out direct with your housing department. I think they MAY be okay as long as they are getting the full rent each week/month. I dont know whether it would be safe while you are away, the council certainly would not be responsible if it got broken into, and you may have to pay the repair bills yourself direct to the council, as the premises will be empty. The only other way is to find a friend or relative who would live in the property, but not tell housing, but this could cause major problems for you.

A friend of mine rented his out to a mate while he was away and never told the council. when he came back the mate moved on and no-one was any the wiser.
