Whats your advice?
hi, i just want to know if i have a say here on my current dilemma. 5 months ago, i found someone who told me that he is looking for a bedspacer for the vacant room in their house. i gladly accepted as it was very close to my workplace, just 5 miles away. i pay him 500 dollars a month not including electric and cable bill. now the problem is he is asking me to leave by the end of this month as he is moving out of state and a family will move in to rent the whole house out. i told him im not ready to move out and he feels that more than two weeks is enough for me to find a new place. he said he was very sorry to do this to me but he said he has no other choice. what do i do now? and if incase you want to know if we had a written agreement on my stay there, there was none.

Unfortunately you have to go. You may sue for any costs you might incur trying to find a new place in such a short amount of time, because even if there is no lease on the premises, it is assumed that a 30 day notice is proper notification(You have to check your local law, but 30 days either way is the norm) . Anything less would be breach. What about your security deposit? Are they going to return that since you arent staying the month? Put them in small claims as this was bad business if they dont compensate you accordingly.

Then you need to be out by the end of the month. If there was no written or verbal agreement on how long you would stay there he has the right to ask you to leave at any time. I know it is not a good situation, but unfotunately unless you can negotiate something with him he is within his rights.

If you didn't have a written agreement than state law determines the length of notice. For example, in MN (where I live) it is 28 days or 4 weeks. Research tenant rights in your state and that will give you your answer.

You said that He gave you more than two weeks, that is plenty of time to find another place to live. If I were you, I'd be taking advantage of how many days you have left to find another place to live. If you want to be stubborn about it and not respect that He owns that home and only rented a room to you on a temporary basis, you'll soon find yourself evicted with no place to go.

It's almost a ridiculous question. You shouldn't be wasting time asking people what you should do on Yahoo! Answers. Find you another place to live, pronto! And get out of that Man's home like he asked you to....comprende muchacha?

estielmo
He is required to give 30 days notice, but you will be in quite a dilemma when he moves out and the others move in and throw your stuff out.

Avoid the stress, just move and sue him later.

Technically, the law's on your side. Without a lease, you're in a month-to-month tenancy,,. which in most (all?) states requires the "landlord" to give you 30 days notice (or a month... check your state's details, since they differ, but that's the ballpark) before kicking you out. He can do that anytime he wants, btw, but it just sets the clock ticking.

HOWEVER, practically speaking, what are you going to collect? The guy no longer owns or controls the property, and the new guys have no obligation to you whatsoever. If you're paid up for a month, and he's only giving you a couple of weeks, you can collect the unpaid portion, but you're still out of there.

Good luck finding a new place.

Id start looking for a new place. his hands are tied. He is no longer in charge of the house and room , the new people are. He stated they want to rent the whole house out which leads me to belive 1 family not multiple renters.

There's nothing legally bind if there was nothing agreed to that was put down on paper ,,,, If you pay rent on a monthly basis I believe that is the usual amount of time that should be given a tenant to search for and move into another place but like I said if there is no written contract then nothing is binding ,,,, He could have told you that he wanted you out within a matter of days ,,,, In some cases even a lease is not binding though ,,,,

I use Google for your answers.

You had a verbal agreement which is just as good. And I think depending on which state you are in he has to give you one month, to move out.
