Years ago I rented from an attorney. He actually stated in the lease that I owed him $5400 due in 12 installments (clever). Made it clear to me!!

My co-worker has it specially entered in his lease that if he should move out ahead of time, and even if the landlord rents out the apartment, he is still responsible for the rent thru the end of the lease-his landlord is a jerk

The only fly in the ointment would be if you didn't take care of something you should have. But, even this would need to be documented.

You need to show that you are trying to rerent the place.

You can only sue them for the time that the place was empty.

It depends - you should have given yourself rights in the lease. But probably. Sue in small claims. You do have a duty to find a replacement tenant though, and if you do then the first tenant won't owe you any more money for the rest of the lease, since you can't collect rent for the same month from two different tenants. You have to show that you are marketing the unit and trying to find a new renter for it.

But - if you rent it out again, you can only sue for the time it was actually empty.

And sueing a person does not necessarily mean you will collect. You sue, they lose, they get a judgement against them. You can attach property, garnish bank accounts, etc. If they have nothing, you will get nothing more than the satisfaction of having won your lawsuit.

SURE. READ your lease with them. You probably have a duty to ameliorate damages, meaning you have to make efforts to rent it out, not let it set empty. No court will allow you to just sit on it, even if lease permits it.

You are required to advertise and fill the place as quickly as you can with a qualified tenant. Once the place is occupied you sue for the unpaid rent during the vacant time. But if you abuse this the judge may throw out your whole claim, so get it fixed-up and rented out quickly.

yes. they are obligated to pay for the remaining time because they are in breach of contract. You will need to file this is small claims court. Unless they had a very good reason, some extremely extenuating circumstance the judge usually favors the landlord.

You can sue, but you need to try and re rent the property. The amount you can sue is for actual losses.

All good answers - one thing not mentioned is that with a judgement, you can impact their credit file for all future prospective landlords to see. They can easily forget to list you as a previous address, or reference, but a credit report is another thing.
