When a tenant gives 'written notice' when wanting to terminate a rental agreement. Does by email count?
We want to move out asap. The contract states 1 months written notice (nothing about it being signed). I emailed about 2 weeks ago, can I now write a signed letter and back date it?

No, "notice" indicates signed. Your signature has to be on it to make it a legal document.

How do you know the landlord received the notice. Some people don't check their emails for weeks.

It needs to be delivered to the landlord.

Yes, email counts as written, as long as you have a copy of it, that should be sufficient. It's even better if they replied. You should print out a hard copy of it.

You need to put your request in writing, on a piece of paper, not in an e-mail, sign it and forward it to the landlord. And no, you cannot backdate it.

I would send a letter certified mail saying per my email....and enclose a copy of the email you sent to them.

There was a review of the communications act in 2000 (or somewhere around there) that made emails written statements. However virtually all tenancy agreements in the UK make a provision for notices for termination having to be sent through the post recorded delivery or hand delivered.

This is more for security than anything else, emails can get deleted or lost more easily than letters that have to be filed. Plus if recorded delivery there is a referable paper trail to track the letter.

If the landlord has provided you with an email address, especially if it is on his headed paper or on the contract, that is an implicit acceptance that communications will be accepted by email.

This can be overridden by specific instructions to the contrary in the lease, but emails are writing so if the only requirement is "in writing" then an email is perfectly fine.

Enclose a copy of the e-mail you sent, too, just in case. This should do the job.
