When can a basement or rooms in a basement technically be cosidered " living space " ?
In other words ..... if a home seller has a tv and furniture in the basement ..... can they list that as a family room ??

Some of these answers are almost right and all the answers are somewhat incomplete.

The room is finished if the room has finished walls and a ceiling (usually suspended). The floor can not be bare concrete or dirt. It can be covered directly with carpet or tile but that is not a good way to do that. The real criteria for this room to be part of the legal square footage of the home is that it must be heated by the homes system (ducts) or a separate legal heating system.

In appraising the home, the "finished" basement room (or rooms) is usually assessed at a fraction of the $/square foot of the rest of the home. Depending on how much of the area is below grade level, the assessment can range from 25 to 60% of the $/sf average for the rest of the home. When considering a price for a home you want to make an offer on, take that into consideration because too many listing agents misprice their listings.

No, not unless the basement is "finished." That means actual walls instead of concrete blocks, actual flooring instead of concrete, etc. Like upstairs.

Technically , When a ceiling is installed in a sub-space, basement,, for tax purposes and listing purposes it becomes considered "FINISHED! Just furniture, or even covered concrete, does not become finished status.. The answer to your question then would be NO, they could not technically list the property as with finished basement.. I have done basements in furniture and bar and left the ceilings 'floor joists' exposed simply to avoid being assessed taxes on the basis of being considered finished.. Hope this helps!! SOLOMON

finished space qualifies IF the work meets the building code in your location [at the time the work was done and IF permits were pulled at the time if they were required and IF the space passed inspection from the building department if inspection was required at the time].

As all too many home sellers discover, if permits and inspection were required but not gotten, then an inspection may be currently required under the present building code -- and if the space fails that inspection, the remedy is to either bring it up to code [at seller's expense], or remove the nonconforming work. [Or sell with the explicit statement to the buyer that the space is legally uninhabitable -- which'll usually kill your price in a real hurry.]

If it is finished and looks decent I would consider it living space. Depending on the style of house I would think they can like a tri level home but a regular two story with a basement I would think that would be listed as a second family room or a rec room. It cant possibly be the actual family room or I would sue the builders. lol

If it's finished in a practical sense - i.e. drywall or paneling and carpet or tile - it's a finished living space.

I think that anything with covered walls, electrical outlets or lighting, heating is considered a living space..
