MARK D | When is a rental lease agreement binding if we sign the lease before the actually date the lease starts? |
My wife and I signed a lease on 25 October 2008 to rent a home to accommodate the LL because they live out of State. The Lease agreement does not start until 1 NOV 2008 as stated on the LEASE. When is the lease binding, the 25 OCT or 1 NOV? |

The minute you signed it. |

The lease term begins on Nov. 1st - your lease agreement should state this as the date.
Your obligation to honor the lease agreement is binding the day you sign the lease. |

The lease is binding the minute you sign. It does not come into effect until the 1st. |

The lease is binding as soon as it is signed by both parties to the contract. If the lease states that your occupancy starts on Nov. 1, that is when you can take occupancy. |

It is binding on the 25th and commenses on the 1st. |

A legal document is valid from the day it is signed and is binding from that point on.
The term of the contract does not start to take effect until the 1st of Nov. Which means that no payments etc. have to be made according to the contract.
If there was a security deposit or anything else involved that you had to pay then that has already become part of the contract.

I assume you are asking if you can break the lease prior to Nov 1. The answer to that is a resounding No. It was binding the moment you signed it. Put yourself in the landlord's shoes and you can see why the law is specific on this point. Once they have a signed contract they take the property off the market thereby losing the opportunity to put another tenant in by Nov 1. |

I Buy And Sell Houses
 |
As the others say, it's binding as soon as you sign it. In your case, October 25. The tenancy begins on November 1.
Think of it this way: If you were buying a house, you'd sign an agreement today (which is, as I write, October 31). However, you'd specify a closing date a month or two later...let's say December 15. The agreement would be valid/legal as of October 31 even though the purchase wasn't going to occur until December 15. |
