When renting a home, whose responsibility is it to maintain the gutters?
I am renting a home for the first time and my landlord put cleaning the gutters in the lease. At the time I signed the lease I didn't realize the danger in doing the gutters myself. I was told that this was not something a tennant is responsible for. I want to have that part of the lease rewritten and I want to have some type of legal support that this is the responsibility of the landlord before I suggest the change. Does anyone know of something that would support my position? Thank you.

Thank you for your many responses! Unfortunately I'm still not sure what legal standing I have. First of all let me say, I DID READ MY LEASE and at the time 2 years ago I thought that it wouldn't be a problem. However, there are wasp and bees nests embeded in the gutters and it's obvious that none of the other tennants have never cleaned the them. I recently had someone to do it for me and paid him. In addition, I have been the best renter she's ever had because I have landscaped her yard (due to the fact that I love to garden) Most of the minor maintenance I do myself and I don't mind, however, I do feel that this is all her property and she benefits from all improvements that I've made. Therefore, gutters are part of the roof and the building itself, plumbing, electrical etc. is her responsibility. I rented an apartment before this and I would never expect to clean gutters in an apartment. Why is this any different??

im in real estatend im petty sure the law is if its over 2 metres high its there responsibility .... legally they have to change light bulbs as well so youdont hurt your self take it t the RIENT and discuss it further or ring your agent im guessing its a pivate rental as they always try to DUPE tenats

READ your lease.
Your lease is a signed legal document and you cannot unilaterally change its terms, only by agreement between you and landlord. Frequently with houses, the tenant is responsible for routine maintenance like lawn mowing, leaf raking and gutter cleaning while the landlord is responsible for repairs.

Your position is untenable. The law does not require the landlord to clean the gutters. The law does not require the landlord to do something you feel is too dangerous for you to do. YOU AGREED to do it and you are bound! If it's not something you can do, then it is your responsibility to hire it done.

It's not that dangerous either. As a 55 year old man my husband cleans the gutters from a ladder and I clean them from the flat roof. Scoop out the leaves and stuff, wash them out.

If you signed the lease that says you will maintain the gutters, then you are responsible for that maintenance. If you can't do it yourself you will have to hire it done. A tenant is responsible for anything written in the lease. Don't listen to what others are telling you. You can try to get that clause in your lease amended, but the landlord does not have to agree.

If you agreed that cleaning the gutters is your responsibility when you signed the lease, then you are responsible for cleaning the gutters.

You can rewrite that term, if the landlord agrees. He'll probably want some extra money, though.

If it's dangerous, hire someone to do the work for you.

If you rent a house, you are responsible for maintaining the entire property: mow lawn, shovel snow, clean gutters, paying plumbers to fix leaks/clogged drains, etc. You are also responsible for paying all of the utilities and bills: water, sewer, electric, trash, phone, cable, gas or oil, etc. If you cannot or will not maintain a house and yard, get an apartment where the landlord would be responsible for the exterior of the building.

Since you already signed the lease, it is too late to change this. If you cannot or will not clean gutters yourself, hire someone and you pay the bill.

This is why you should read a lease BEFORE signing it. Before signing you had negotiating power to tell the LL that you would not agree to that clause and request that he cross it out. Once you sign it you agree to everything in the lease, and therefore cleaning the gutters is now your responsibility. Technically that is actually a LL responsibility but now he's made it yours.

The only recourse you have is to renegotiate the lease at renewal and tell the LL you do not want to be responsible for this.

If he disagrees you can do one of two things, hire a company to do this work or move out at the end of your lease.

You are renting a single family home, which includes more responsibility than an apartment because there is no common areas.

You agreed to maintain the gutters per your lease. Whether you personally clean them or hire it out is up to you. If you fail to perform the duties that you agreed to, the landlord can have the gutters cleaned upon your move out and legally deduct the cost from your security deposit.

You cannot unilaterally change your written lease and the laws in your state do not support your position.

Per Michigan laws, the landlord and the tenant may, by mutual agreement (your lease), modify the landlord's duties for repairs and maintenance and make the tenant responsible, but only if the lease is for one year.

it is the landlords, you just rent, not own. Unless it is stated in the lease, do not do it. Do not sign anything you have not read. If you do it, make sure you get paid for it, or money is taking off your rent payment. Do not get fooled by stupid landlords, know your agreement. All you do is rent, not own. They are responsible for all maintainance on home, not YOU!!! Unless stated in lease, make sure you make your terms in lease. All contracts signed are negotiable, make sure you refelct your ideas and opinions... DON'T LET THEM SCREW YOU OVER :)

the owner/landlord is definitely responsible for this unless he has given you some kind of discount on rent and it is in writing.

Actually cleaning the gutters is not really hard to do, but the reason you rent is to NOT deal with those things. I would pay a small fee and talk to an attorney and find out your rights.

When renting the house the landlord is responsible for the work. Call the gutter company and send the bill to him or deduct it from your rent. You pay big rent and should be responsible for something. Consult an attorney I'm sure he would agree.
