It will be both. Your landlord will have to go through the extensive, time-consuming, and expensive ordeal to evict you unless you leave on your own. If you break your lease and can't work anything out with your landlord, you will be liable for the remaining months' rent through november, and your credit history will be hurt. It will make it more difficult for you to rent somewhere else because this whole episode will show up on your credit report when the next landlord checks you out. |

They can sue you for breach of contract. If they win..they will get a judgment against you.
They will then hire a collection agency/lawyer to actively collect on the judgment. The judgment will be on your credit report of at least 10 years..or 20 years if the landlord renews the judgment.
The collection agency/lawyer will garnish your wages, levy your bank accounts, seized your IRS returns and place liens on any property (car, home) that you may own.
Do you really want to dodge all of this for the next 20 years? |

eventually they do. depending on where you live, there is a process they have to go through. In California, they demand payment, then eventually you get a three-day vacate notice, then you end up with a sheriff at your door and a padlock put on. i think the whole process takes about a month. but you signed a lease- you are legally responsible to pay all rent till November, whether you live there or not. they can take you to court. try talking to your landlord- they often will work something out with you to avoid the hassle of eviction. |

You are responsible for the rent to the end of November. It does not matter if you live in the apartment or not, you are still responsible for the rent to that time. If they kick you out and then rent the apartment to someone else, then you are only responsible for the rent to the day the new renters move in. If they lock you out, they can not rent the apartment and are expecting you to pay the rent so you can get back in.

They cannot legally lock you out. You will be served with an eviction and if you do not obey by the one your landlord gives you then they will proceed with a court ordered eviction. What you could/should do is explain the situation to the landlord and try to see if s/he will allow you to stay for the month under the condition that you are out by Nov. 1st and you pay for Oct ASAP. You'd be surprised by how many landlords will work with you. |

i suggest you make offers to pay the rent and the areas; at a reasonable rate over a "Reasonable" period of time. They will then have to serve a notice seeking possession that will buy 56 Days and by the time the have a warrant for possession another 56 days will have passed which, I belive is 4 months |

ok check this out they can not legally put u out without a legal eviction notice most states require a 90 day stay before u can b evicted but it does vary from state to state since your lease is only a 6 month term i would suggest contacting a free legal service in your area. |

It is illegal for the landlord to kick you out or lock you out for missing a month of rent.
The eviction process takes about three months to complete before the sheriff will come and remove you by force, and they need to give you a 30 day notice, unless you are being evicted for criminal activity, in which case they can give you a three day notice. So you are allowed to stay, despite not paying rent, so don't worry about coming home to find yourself locked out.
However, that doesn't mean you don't have to do something. The best thing you can do is to give your 30 day notice to vacate immediately. Even though you have a lease, the landlord is required to make a reasonable effort to fill the vacancy if you give a 30 day written notice of intent to vacate. He can charge you for any incurred expenses in that effort, including the price of posting internet or newspaper ads. Giving your 30 day notice now would pose you the best chance of owing as little back-rent as possible once you vacate.
If, after a reasonable effort, the landlord can't find a new tenant, then he is legally allowed to collect the rent you would have paid had you stayed through the lease, and can have your wages garnished for the full amount. That's the worst-case scenario, of course...if your landlord is reasonable, you can draw up your own contract to settle a monthly payment out of court for the missed rent you won't be able to pay. It takes a LOT of time, paperwork, and aggravation to do an eviction process, so you if you impress upon the landlord your situation and he sees you making the best possible effort to work with him, you might just be ok. |
