you give them a three day notice if they don't pay the rent in those three days then it gets serious. The cops come and escort the person out of the house. They have a limited about of time to gather their things. Once the tenent is gone you can do whatever you what to the locks. |

No, because you legally have to give them a 30 day notice in order to take action to evict, which then requires another 30 day notice, then a court hearing, etc, so basically, they have anyplace from 30 to 90 days before the locks can legally be changed. |

That depends on the laws in your state. contact the court about the law's. You may have to have them served papers. I had a renter who stopped paying rent and we changed the locks and moved there stuff out...we had to inventory everything as we moved it out...then the renter had to also pay a storage fee to us for storing it in our garage. In some states...because of the extreme weather law's are different...you cant make them move until several months notice has been given. Know the law's and one up the renter...or they may one up you! |

WOW it's amazing how people make attempts at answering and they have absolutely no clue waht they are talking about!!! PLEASE READ BEFORE YOU FOLLOW PEOPLES ADVISE ON HERE!!! First off, no advise can be asked on a nation wide website such as yahoo. Tenant/Landlord laws vary from state to state, county to county and city to city. PLEASE CHECK WITH YOUR LOCAL HOUSING AUTHORITY prior to making such a bold move. Just type in, for example, ENED OKLAHOMA HOUSING AUTHORITY and info will pop up or whatever city and state your from.
NOW---- I am a property manager and own my own management company in Los Angeles, CA. Our laws are very clear cut and im sure are common with other states/cities but you shoudl check. A 3 day notice ONLY is given after the tenant has not paid rent and after the grace period that is on the lease. The tenant has the 3 days to pay up the rent and be current, (the late fee is not part of the deliquent amount). The only option you have is to accept the rent within those 3 days. If the tenant doesn't pay after 3 days then you can start the eviction process. You may not lock the house or change the locks until you have filed and won a judgement on the case by a local court. This process in LA, CA. takes abotu 15-45 days from when the 3 days is up! (Usually around 30 days). Tenants in California have (unfortunatly) a law called the tenant quite enjoyment act (look it up, it might be federal law). This gives tenants the right to stay at the property and fight it with the landlord in the court of law. |

No. The three day notice is part of the eviction process, not a substitute for it. The landlord cannot evict, only the court can. |

wow the answers are all over the board but I agree with horndog. I think you have to give them legal notice. Renters have rights as well. I dont know what your state laws are where you live but just changing the locks with a signed agreement would never fly in the state of utah.
Call your local sheriffs dept. they will know. |

Depends on what the laws are in you're area read up before you get sued!
Some times even though you have a signed agreement it takes up to 90 days to get them out even with a court order.
This is why I dont have rentals. |

From watching Judge Judy on TV it is my understanding that you cannot give only three days notice. You have to give 30 days after which you can have the tenant evicted. Then you can change the locks. |
