I have never heard of a yearly lease that stated you had to move out when the lease expired. They generally go to month-to-month. You should have given your 30 day notice.
Yes, he can keep you deposit, AND sue you for another months rent. You are the one in the wrong.
Unless there is a 5 day grace period in your contract there is no such thing. Rent is late the day afterit is due. He can charge as much extra as he desires, but the amount had to be in your lease. |

Your lease probably states that you go month-to-month at the end of it and that you are required to give 30 days notice. Go READ it.
Landlords don't typically stop by every apartment that has a lease expiring. Can you imagine how much time that would take?

sorry, I think you are hooked. The contract is automatically renewed unless broken by one party or the other. you should have given notice you were moving. And if the contract says penalty for late charges, then penalty is legal. |

You clearly did not read your lease. All the questions you're asking here are in your lease. As a manager, I get irked when people treat a lease signing as just a formality to get into the unit. You need to take that lease seriously. It's a LEGAL DOCUMENT that will be taken seriously in court even if you didn't.
Yes, your landlord can take your deposit because you left him without enough time to find a tenant for your apartment. Now, he's going to lose money while trying to find another tenant.
Each place has its own grace period before charging a late fee. Again, READ YOUR LEASE. |

Someplace on your lease there should be a clause about termination of the lease. It should state that 30 days notice shall be give to terminate or extend the lease. There should also be a clause on your lease about late fees, telling you if you get a 2 or 5 day grace period.
Read over your lease tonight and also check with your states web-site. There might be a link to some type of free legal advise. If not, pay the $100 to contact a real estate attorney and see if they can help.
In my opinion, he is also at fault for not checking with you to see if you planned on leaving or not. Right now, you don't have a valid lease with him, so you would be considered a "month to month". If you don't have a place lined up, stay for this month while finding someplace else, but let him know that you plan on leaving at the end of the month.

The lease or contract you signed should state that you need to give a 30 day notice upon moving out. It doesn't really matter if he explained the written lease to you, as it is your responsibility to know what you signed. If it doesn't mention 30 day notice you need to look up tenant rights within your state as rules vary from state to state. As far as charging a late fee, if it is in the contract and your state allows the owner to do so, he/she can. Some states do not allow a late fee to be charged and the landlord can simply evict if the renter doesn't pay on time.
You can't just expect the landlord to be happy if one day you say you are leaving without giving notice. Notice is given so the landlord can try to fill the apartment while you are still there so he/she doesn't lose any money. If it is in the contract or if it is a law in your state that 30 days must be given, he can keep your security to recoup his/her losses. |

typical to charge a late fee
seems lately it isn't uncommon for some landlords to want to charge $75 for a late fee
I'm not saying it's fair, but check the lease
it's usually in the same paragraph up at the top where it says how much you're paying every month
30 days notice isn't uncommon, although insane
to stay another month most leases would require you to resign
it's in the landlord's interest to find out if you're resigning and do it the month before the lease ends
that way they can be prepared to get it ready
you're screwed on the next month's rent, you're stuck paying it
but if it was labelled a security deposit, he can't keep it
I've seen this one on Judge Judy, a security deposit is not for the last month's rent
although, you ain't gonna win that fight

ask the manager to write it off as a returned security deposit and noted paid last month's rent
it'd be better for you if he repeats that the security deposit was returned but that you paid a month's rent for not giving notice
that wouldn't be bad for a reference, so be nice about it
unless the landlord is "really raking you over the coals" I'd let it go
these things don't end well
and they never result in a good reference
it's in your interest to play nice if it's equal to the last month's rent
otherwise, Judge Judy would tell you to pay the last month's rent and request your security deposit back |

honestly - its a signed contract, a binding contract, and a written contract.
either way he will find a way to take your deposit.
anytime in an apt. DONT expect your deposit back...

Re-read the lease. You both have to follow the lease. That's about it. Sounds like you have a fight on your hands. I don't know if you have a renter's board or anything like that in your town. Once you re-read the lease, put your arguments in writing and send it by registered mail or put it in his hand. You should have all the dates and activities documented in case you have to go to small claims court. (I'm not a lawyer.) |
