For me to withold the payment of rent to my landlord for work not done to the property that are his responsibility. For example...taking care of a damp basement, taking care of a worn down foundation that causes a damp basement,electrical problems within the property ( blown light bulbs every 2 weeks.), mold in the basement(due to the dampness mold is growing on items that have been stored there), etc.

Be careful, in most places you cannot withhold rent for ANY reason. You could get evicted for that.

That is the housing department for your state, and handles all complaints of tenant/landlord issues. Here is the link to the local office phone numbers:

I know the laws vary state by state, but generally speaking you can withold rent for non-repairs. In order to do it legally, you usually have to file a complaint with the housing department and appear before the housing board. They will then issue a decision which allows you to create an escrow account in which to deposit your rent until the dispute is resolved and the court decides how much rent you owe for the months when you were living with mold and broken appliances etc. DO NOT start witholding rent without going through the housing office or your landlord will have grounds to evict you. The housing office should be able to walk you through the whole process, so just give them a call! Sorry about your problems, I have had to deal with the same thing and it sucks! Good luck!

You didn't say where or I would be better able to help you find help. Here is one in the state. Just google or yahoo search for landlord/tenant disputes using PA for the state. Good luck I'll bet the department of health would like to see the mold! Just a thought but, it might get you tossed out immediately too!

The first thing you need to do is cover your own butt. Make sure everything you do is in writing. You need a paper trail in case this ends up going to court.

Write your landlord and let him know the repairs that need to be done. Tell him that the problems have lasted a while and that you need to have them taken care of as they are affecting your personal property. Don't get nasty in the letter. It's best to keep emotio0n out of all of the correspondence. Keep everything factually based. What the problem is, what has resulted from it. State that the problems need to be rectified. Simple and to the point.

If you get no response from him within 10 days, send another letter. Sometimes it's best to send the letters certified mail so that you have proof of delivery. I would send 3 letters each 10 days apart if he doesn't respond. In the last letter I would then state that since this is the third letter and there has been no response you are being forced to find other alternatives to resolve the problem and that you will be contacting the town/city/state/etc agencies to get the matter resolved.

At that point I would contact the other agencies to see what can be done.

Well I know for a FACT that the mold is a health hazard and he should be taking care of that at the very LEAST.

The easiest thing to do is to buy a dehumidifier. My basement would be similar to yours if I did not have one.

You can withhold rent to repair the 'problem' yourself IF you have given the LL sufficient time to repair the problem AND he hasn't done so. You could give him the receipt for repairs (or the dehumidifier) and the rent so the total is your monthly rent.

But you might have to prove in court that you notified him of the problem and that he did not repair the problem. This problem must make the unit unlivable. I think mold growth might be considered unlivable. Also buy a bottle of bleach and apply it with a garden sprayer to the moldy areas. Then start the dehumidifier. Remember if you do this, the dehumidifier is the property of the LL, since you deducted that amount from the rent. So don't take it with you when you move.

If you simply withhold money, you better put it in a SEPARATE bank account and be prepared to give the judge the bankbook, if it ever comes to that. The judge will not believe you if you say you are holding the rent in your sock drawer at home.

It might be easier to simply move.
