werky | Where would i find out where the official right of way is through my boundries to adjoining properties? |
I live in an end terrace and have a right of way through the boundries for access to the other houses back doors. At present we let the neighbours use our front gate and through our courtyard to their houses. I do however know this is no the 'official' right of way. i vaguely know where it is but where would i find out for certain, i have looked through all the documentation i got when i bought the house and i have no pictures just a sentance about the 'OFFICIAL COPIES ENTRIES'? where do i find this e.t.c.?? |

Sounds like you live in a multi-residence property (condo, townhouse, etc.) Normally I'd say to check your property survey, but you probably don't have one. There should be something in the HOA covenants. If not, then I would simply lock my gates and not let the others pass through my property. Let them prove that it is a legal right-of-way. Do it now, because if someone fell down or something while passing through your property, they could sue you.

you need to check the deeds to see if there is a covenant which grants rights of passge over your land.
just be careful that as the fact they are using your front gate regulary may be a point of dispute should you stop it or a new person moves in as wishes to use it as well and you dont want them too.
if there is a covenant, then you should of been informed of this at the time you bought the property. |

sometime there will be a small diagram to illustrate boundaries but if not it will just be a list of measurements with you will have to work out yourself |

i would check with your local council although they don't own your house they will probably own the land around it so that would be a good bet if not go see your solicitor he will probably be able to find out for you.dont forget its a public right of way so the councils a good bet. |

The person who has your deeds to your house will have this info. E.G. if you still have a mortgage, the bank or building society where you have your mortgage account will have the deeds. |

There should be the Official Copy Filed Plan as well as the Register with the title deeds. On the Filed Plan, your boundaries will be edged in red and reference will be made to any rights of way on the Register Entries. If in doubt, ask a solicitor to have a look for you. |

It sounds as if you live in a condo development, in which case the right of ways and other easements, etc., granted with the land would be explained more fully in either the 'Declarations and By-laws' of the development/association, or you would need to go to your local courthouse and look up the 'plat map' that was recorded with the plans to the city/county for approval back at the inception of the project. If a title company was involved with the closing of your purchase, call them and ask them to get you the information. They may have it on file or will be able to obtain it for you the quickest and easiest. |
