Which homeowner is responsible?
i have a tree in my yard that my neighbor trims periodically because some branches are on his side of the fence. then he throws the branches in my yard.....who is responsible for disposal

your neighbor cuts the branches cause he wants to, its his responsibility to get rid of them also

If that tree fell over in his yard due to a storm or something.....he would be responsible for the removal.....however, good neighbor manners would dictate you offer, but that's beside the point.....

he is illegally dumping on your property......tree branches not attached to the tree do not "stay" your property, that's ridiculus.

He cuts, he disposes of them......what a jerk....

Cut down the tree & end the problem. You also need to try to get along with your neighbor. I have a neighbor who has trees. The limbs break off & fall on my property. His trees have cost me $8000 in the past 4 yrs. I asked him to trim them or remove them. He got obnoxious with me. I checked w/ the local PD & they told me I can return his property to him anytime it lands in my yard. Thus you have to clean up your mess from your trees.

If he cut them then he should dispose of them. I think any branches on his side gives him a right to trim them.

Whoever cuts does the disposal. You got two choices. 1) throw them back over. Or my favorite 2) call teh city and request he is tickted for dumping!

Your neighbor has the right to trim that portion of your tree that protrudes onto his property. He is merely returning your property to you for disposal.

he has to legally offer them back to you as it is your tree, he could dispose of them and get done for theft

i do that..
i base it on his roots and when he asks me why i say
"be thankful i am not billing you for my work"
it's your tree..not mine i don't want it..
he could trim it on his side before it comes to mine so it's his..
and..when i do have to pay someone to trim it..i will be giving him 3 estimates on which on to do via registered mail..
and photos. and going to court if needed.
