miley is stupid!
While I was visiting my property to collect rent, my tenants' pit bull attacked! What can I do?
Yesterday I had to go visit some of my rental property to collect rent, like time and time again.....the tenants left when they found out I was in town. I was surveying the property when their pit bull (normally chained) attacked me. I have several puncture wounds and gashes that, under normal circumstances, would be stitched, but since they are dog bites, the hospital left open. What can I do about my tenants' negligence to properly secure their dog? It has bitten someone before...and now me. What should I do and what kind of legal action can I take?

I am surprised the hospital did not call the police, they have to in CA.

YOU need to get this animal off your property immediately.

YOU, the LAND OWNER, will loose your shirt if this dog hurts someone.

And unless you got a bond for that specific animal I can almost guarantee you that your insurance has a clause that dangerous breeds of dogs are NOT covered.

It was really stupid (sorry, but that is the truth) of you to allow someone to keep a dangerous animal on your property. You are a sitting duck for the legal system.

I would be calling the police, humane society, whoever necessary to get rid of that animal by Monday morning.

In CA they have to be euthenized after attacking 2 people.

That dog could kill a child next and you will be the one on section 8 then.

Call the police and file a report against them. Next I would suggest calling Animal Control too.

For starters, you are out of your mind allowing a tenant to have a pit bull on YOUR premises. You can sue your tenants for the medical expenses, but chances are they haven't the money to pay it, since they can barely pay their rents. If they have renter's insurance, chances are it does NOT cover pit bull attacks. It's almost impossible to get such insurance with a pit bull.

I suggest you check with an attorney and find out how to make them get rid of that dog. You could be sued if it bites someone.

Get a lawyer immediately and have them start your case! Take pictures of your wounds, the scene, everything.

Also, you may want to start carrying a handgun to deal with this problem in the future.

You should start by filing a police report. If this dog has bitten before then the police or animal control need to do something.
The next thing you need to do is give the tenant 5 days to get renter's insurance to cover the dog in case it bites anyone else. They most likely will not be able to insure the dog. If the dog bites someone they can go after YOU as the homeowner. If the lease does not allow dogs you can tell them to get rid of the dog and begin eviction procedings for breach of contract. If the lease allows for dogs you may want to consider changing future leases to not allow bully type dogs.

I'm sorry for what happened to you. You already went to the hospital, so thats good. Since the dog has bitten someone before, and now you, it will probably be put down. In my area it is illegal to tether your animal. I may love the breed and even though it may have been protecting its home, its still not right it bit.

As far as community guidelines go...The easy way would be to not allow dogs that are considered dangerous. Now, I'm not saying that you should allow any type of dog on your property.
Being an owner of an American Staffordshire Terrier (commonly mistaken as an APBT) it's so hard to find somewhere to rent that is decent and safe. I didn't get my dog for protection and she is useless when it comes to that.
In my lease, owners of these breeds have to take their dog to undergo an extensive temperament test. We have to bring the results to the office in order for us to keep them on property. The temperament test I took time through was not easy nor cheap...They usually aren't... Anyone that cares about their dog enough (good owners and so on) will be willing to pay.
And to who ever said you can't get these dogs on renters insurance, you can. My dog is on mine and it changed a whole 20 a year. The temperament tests do a lot.


as far as the tenants go, warn them they need to do something about the dog. It can't stay there since it has clearly shown aggression to you. THey need to reimburse you for your medical bills and they need to start paying rent on time. sounds like they were skating on thin ice before the dog bit you.

If the owners of the dog were not escorting you on the property, and you were attacked, that would be difficult for you to pursue as far as legal actions go. The dog was obviously "guarding" the house and to the dog, you were an intruder. Most renters' rights say very clearly that the renter need be aware of your visiting the property, and that they must be notified before your arrival, and once you are on the property, you must be escorted by the renter. Renters rights are a complicated mess, which enable them to not pay you their rent! Also, keep in mind they probably do not have the money to pay for your medical bills, but homeowners' insurance should cover it. Perhaps, you should include a NO PETS clause in your renters' agreement...
