Who gets house?
I meet my wife amost 3 years ago , dated a year and married for almost 2 years. She has a son age 7 that also has been living with us. I have bought a house a year ago with my name on the loan and only my name on the deed. Who will get the house? She cant afford it but i know she will stop paying to ruin my credit. I refuse to leave because i pay for everything. Does one of us have to leave and who? also what if i leave until it sells but she trashes it so it never sells. If you live in a community property state, your wife will be entitled to half the property and assets obtained during the marriage. If your loan documents state your 'sole and individual property' or words to that effect, ask an attorney if that protects you from the community property law?

if you bought it together (while you were married) you both own a portion of that house, even though title is just you. If you get divorced she is entitled to half of that house.

If you bought it before you were married you are the only name on title, it's yours, free/clear.

Since you bought the house after you were married, it is considered a marital asset. She is legally entitled to 50% of the value from the sale of the house. Even though it makes sense for you to keep it since she has neither the credit nor the resources to remain there, many judges won't see it the same way.

If you try to throw her out, you could get yourself in serious trouble. The best way to do this is to get her to agree to move out. Help her find a place and then help her move into it. It will make you look like a great guy, and get her out of your house.

If she fights you on this in court, you will probably lose. No judge is going to throw a woman and child out on the street so a bachelor can live in the house purchased with money generated by both people.

So with all that being said, you *might* get the house if you do this right.

Good finance question! I know of an organization that gives up to $1500 to people to help them with their rent or mortgage. It's available in most US cities, I highly suggest you check it out.

I'm afraid that the only way you will keep the house is to buy out her share (if she has a good lawyer, that is what she will do). if you can't you will have to sell. Remember it only takes one to buy but if you are married it will take two to sell unless you are granted a waiver by your wife.

The advice to be reasonable is golden. Both of you will move on to other things and you will realize that the home is only a physical possession, not a mystical one.

You can stay with a spouse as long as you don't fight . Find another way to occupy yourself and get another fridge. Just sit this one out.
