Who is at fault tenant or Landlord?
Our pets got out of the fence, after we repeatedly asked the landlords to fix it, and caused damage to someone else's property. They evicted us and charged us an unauthorized pet deposit for each pet. Now the people are suing for damages. By them charging us for the pet fees does that change anything? Anything will help. This happened in Oklahoma and I looked on the landlord tenant act and I cannot find anything.

Call your Attorney generals Office in your vicinity and ask for Public Protection Division. They can tell you ASAP your rights and send you pamphlets.
I work in that Dept. In PA. So do not take advice from anyone until you call them ...the number is in your phone book.

Your pet your problems.

If YOU KNEW the fence wouldn't hold the dogs, why did you let them in this area? Just because you asked the landlord to fix it, doesn't take the responsiblity away from you.

First - were you allowed to have your dogs in the apartment - doesn't sound like it.
Second - your pets, your responsible - you rented the apartment "as is" you should have fixed the fence - or put up your own barricade to keep your dogs in.
Third - your dogs damaged somebody else's property - you owe them

Did you notice the key phrase in all this is "Your Dogs", it's now Your Problem.

You're at fault. I have never heard of any law making a landlord liable to provide a dog-proof fence or liable for damages a tenant's pet causes.

Pet fee is irrelevant. A pet fee is for the landlord's protection and costs. It does not make the landlord responsible for the conduct of your pets or guarantee a dog-proof fence.

I hope you have a good renters insurance policy -- which is often a condition for authorized pets.

You need to reach a settlement with the people you harmed and/or obtain the services of a lawyer if you didn't have renters insurance.

You may not want to admit it, but it seems like the fault is yours. It sounds you had the pets illegally on the property. If you didn't have illegal pets on the property, they wouldn't have busted through the fence, broken or not. You are responsible for your pets, not your landlord, and especially not your landlord since you weren't authorized to have them anyway. Paying pet fees does not release you from being responsible for their damages.

This is 100% your problem. You can't find anything under real estate law because it will not be there.

Look up laws regarding pet owner responsibility. Your dog - your responsibility.

Your Dogs, you problem.

Pet deposits are standard to cover any damages the animal may due to the unit and also due to the fact that after a pet has been in the unit n order to rent again all the carpets need to be professionally cleaned to be rid of any dander.

Your landlord is in no way shape or form responsible for the damages your animals do. Likewise your landlord is in no way responsible for your failure to monitor your animals.

You are responsible for the care and control of your dogs at all times.

You are responsible to make sure that, if put out in the yard, the dogs are contained and not able to escape.

You are responsible for any damage caused to others property by your dogs.

You put the dogs out in a yard, in which you knew the fence was in disrepair - negligent on your part.

The responsibility for damages is all on you.

The landlord tenant act would not cover this at all.

In fact, it works against you that the dogs were unauthorized.

You would have to prove that your pets were not responsible for the damages to the fence and have proof that you were in contact with the landlords about fixing the fence that was damaged before you moved in. Question is which people, if it is the neighbors then I may suggest hiring a good lawyer. It all lies in the burden of proof. They have to prove it was your pets, etc...
