Who is responsible for unpaid utilities?
I rented an apartment with a roommate. Both of our names are on the lease. The utilities came in her name. Our lease expired and we owed a balance on the utilities which we made payment arrangements for. She left town and will not help pay them off. We we supposed to split the utilities but she is not helping. If they go unpaid will that affect my credit as well as hers or just hers because they are in her name?

If the utilities were never in your name, and the utility company does not have your full name and social security number, then it will not affect your credit.

Go pay half the utilities with cash, and get a receipt with your name on it. Pay cash so the utility company does not have your banking information for any future garnishment. This way, you will have paid your share, and if anything comes of it in the future you are on solid ground.

You have answered your own question.

The utilities are in her name, not yours. So the utility company will go after her, You have two choices if you want to keep YOUR end of the deal.

1) Send a check for your share to the utility company with a copy of the check to her telling her that you have paid your half. Keep a copy of the letter just in case she comes back at you.

2) Send HER a check for your half. Clearly note on the check that it is for full and complete payment of the utility bill and that by accepting your check she fully accepts the obligation to settle up with the utility company. Again, that will cover you in case she comes back later on and says you owe more.

But.. do not contact the utility company in regards to this matter and do not give them YOUR name and address. If you are still in the apartment, contact them and start up a NEW service which is not carried over from the old one. IF they link you with the old service they may start to dun you. It's a bit like ringing a bell.. awfully hard to unring it.

Are the bills coming from the apartment complex, or are they coming directly from the utility provider? If the former is the case, then you are just as responsible as she is, as you are both leaseholders.

If the bills are coming from the utility provider directly, then the only credit that will be affected is that of whoever's name is on the bill.

Since she is not paying her share, if I were you I would go to court and sue her for the portion you paid.
