Who owns the fence to the left and right of my house as I come out of my back door?

When errecting a fence you are supposed to face the good side toward your neighbour. Some do but more don't so its difficult to tell from fencing.
I always believed that the fence on the right was yours but many answers here dispute that.
What I do know is that your deeds will show your responsibility by marking with a capital T the sides that belong to you.

Expert Realtor
Check the survey that you should have got when you purchased your home (too many people waive this, and it always causes problems), and see if it's on your property or not.

If it is right down your property line, then both of you are responsible for maintaining it.

TallPaul
I thought the rule-of-thumb was that you own the fence with the posts that are visible.

FRANK W
look at the deeds but usually yours is the left

J B
First ask your neighbors. Maybe they both put up fences on their properties and you don't own either of them. There is not rule about left and right. When someone puts up a fence, it is supposed to be on their property and the best side of the fence is supposed to face the neighbor. Neither of these things should be used to decide if you own the fence though. First ask the neighbors. If they don't know or you don't trust them, check the deed to see where the property lines are. If one or both fences are on your property and you don't like them, you can take them down. If they are both on your neighbor's properties and they have the good side facing you, there is probably nothing you can do. If the whole fence is on their property, you can't even paint your side.

You need to first verify if the fence in right on the property line or if it is on your lot or the neighbors lot. You will need to check the legal description of your parcel (located on the deed). Then you might need an engineer or a surveyor to come out and check whether the fence sites on your property or the neighbors.

BRIAN S
Traditionally you own the fence if the posts are on your side. However the safest way to establish ownership is to check your deeds. Most building societies make a charge for deed inspection.

Depends upon where the fences sit in relation to the property lines.

Christina K
I have always believed that the one on the left is yours, but there are so many conflicting answers on here you would have to check it out properly anyway.

You will need to check on your title deeds to be absolutely certain but a good guide is to check which side the supporting struts are on the fence. The fences will have a smooth side and side where the supports run - the usual acceptance is that you are responsible for maintaining the fences with supports facing towards you. Don't assume that you may only be responsible for one fence - it's not uncommon for a properfty, particularly an end terrace, to be responsible for the fences to both right and left as well as at the end of the plot.

Think you would probably need to check. My mum's house had a wall to the left (end house with public footpath) so her responsibility was the right hand side. If your left side is fencing, then I believe that is your responsibility.

Ask your neighbour

Silke
It's something to do with what side the fence posts are on.

dukeofspace
You will need to check your deeds to the property. I used to believe that yours was the left and neighbour's was the right. This is not always so. Many fences have a shared responsibility.

As far as i can remember your neighbour owns the left side, and you own the right side, as i had that problem also, when my fence blew down, but me and my right sided neighbour went halves.

Kris to the rescue!
id check the deads, but normally each land owner gets property of the right hand fence - so one of your fenses is your neighbours, but you can still paint your side of it....

Best thing to do is write to your local council, and ask them

Everyone owns the fence to the left as they come out of their back door, so the left fence is your responsibility and the one on the right is your next door neighbours.

Also I understand you are supposed to put the best side of the fence facing your neighbours side.

Tiger01204
You own the right and your neighbours the left

gemma r
If you are renting then get your landlord to check the deeds, generally you are responsible for everything to the left and rear of the property as you look out from the back of the house. Your neighbour is responsible for the same - therefore making them reponsible for the right hand fence (to the left of their house) of your garden as you look out from your house. If that makes sense!
