Hello,
Experience seeing other people in your situation is that the house will be sold and any money left after the mortage is split 50/50.

borrower or co-borrower does not have any barring on this, if both your names are on the deed, then each of you own a half interest in the home, best bet is to sell the place and split the profit 50/50
but no one gets the place outright each party has a legit right to half the profit, either one party buys out the other or sell and split |

You are both 50/50 owners, and he is lying to you.
One of you will have to refinance the home to get your name off of the mortgage note...that is the only way to split the equity, of which you are entitled to 50% to.
If you need out of the home, you can get a Real Estate attorney who will file a motion to force the sale of the home, and will order the proceeds split 50/50.
That is about as much cooperation you will get from the court, since you are not legally married. If you were married, a judge may have allowed you to stay in the home and had him pay a certain portion of mortgage until you could do something by yourself or give you more time to sell it.
That is why I never advise clients to buy houses unless they are married...not a moral issue, but a nasty legal one if something goes wrong.
Both of you will have to move if ONE of you cannot qualify for the mortgage on your own. |

If the house is in both your names, then you own it jointly. If it sells, you each get half - end of story. |

He is incorrect. Your Interest is 50%. However, since you do have 50%, you are entitled to 50% of th homes equity. (The amount the home is worth over the amount owed)
If you decide to take equity and move out, be sure to "Quit Claim" the property to him, and get a copy of it over the Lender, in the event he becomes late on the payments. Youdo not want that to rin your credit. I do not know wat state you live. Som states have "Community Property" laws.
Good luck |

Talk to a lawyer. Get the money. You're not married. Laws will be different for you. I would think, it has to be split. Who is making the payments? Proof? Are the children his? |

Your children don't have any bearing with this. The house is half yours, one can buy the other out by refinancing in one name and giving the other the 50% or you sell and split it. You will get less selling, but it will seem more fair. |

In Law, this house should belong to the person who's name go first. If you think is not fair, you can find a lawyer to fight him with this.
Good Luck!!! |

If as the co-borrower you want to sell and he wants to stay, he'll have to buy you out or sell and spit the money. You probably won't get the house though unless you land a decent lawyer. |
