Who should pay the bill, the landlord or us the renters?
My gas bill came out outrageously higher than in the past. Our gas bill would usually be of 15 dollars, no more than that, but this time it came out of 200 dollars. The gas company came down and they found a leak outside. The leak was caused by the roots of a tree out here, which is is part of the property (apartments). The landlord fixed the problem but he does not want to make himself responsible for the difference of the bill. I believe that because we rent here, the gas line is supposed to be in good conditions,so that's their part. I spoke to the landlord and he said that he is not going to make himself responsible because our next door neighbor called the gas company, supposedly because it smelled like gas. The gas company did not find a leak on the neighbor's side, and even though it smelled like it they didn't check on our side. We never noticed any smell cause it was outside. What can we do. I think that because the tree which caused the damage belongs to the apartments the landlord should pay for it. What can I do?

You don't say where the property is, so local laws may vary. I'd say it's worth exploring to get judgment that the landlord be responsible for this cost. I can't imagine that tenants should be responsible. And if the $200 gas bill came before the leak was repaired, you may still have another high gas bill coming.

Still...you say you live in an apartment building? Did any of your neighbors in the apartment building have similarly high gas bills? If so, maybe you can all band together and go after the landlord for responsibility. Maybe his insurance can cover this if the cost is excessive. You and your fellow renters should probably have copies of past gas bills to show how excessive these current bills are.

I'm also wondering if the gas leak was caused by a tree root, as you suspect, how could it affect your gas bill? At least where I am from, the gas has to pass through the actual meter to affect the meter to show consumption of the product and cost you money. So, was the gas leak on the building side of the meter? Are the gas meters a distance from the building? Where I live, the meters are very close to the buildings.

Anyway, good luck, hope you can get the responsibility for this covered by the gas company or the landlord.

I would say the landlord. It was his tree that caused the problem.

Your landlord is trying to play you for stupid. When you have rental property you should carry property insurance. The owner of the property is responsible for the gas bill due to the gas leak. If the building would have caught on fire he would have been liable.

The contact the Fair Housing Department, the chambers of commerce, and your local city council person.

If you don't already have renter insurance you should get it now. If you have any damages to your personal property it would be covered by renters insurance. The owner is not liable for your personal items, just the building interior and exterior repairs.

If the landlord fixed and paid for the problem then he has de facto taken responsiblity for the damage it caused. The gas company should also be liable for any gas loss from the time te first report came in.

I'd take the balance out of the next month's rent. He can't evict you but he will screw you out of your deposit when you leave.

The landlord should be held responsible for any maintenance of the property (except for damage that you caused). Him not covering it because the neighbors called about the leak instead of you is completely rediculous. If he's not budging on this one, I'd contact a lawyer or small claims court. Good luck!

Have you tried asking the gas company if they will waive the high usage due to the leak? If you ask they may reduce it based on your past use. If not this should be the landlords problem if he won't pay contact an attorney they can better guide you

I would speak to a lawyer to be certain, but it sounds like the landlord should be responsible for his own poor maintenance.

Where I live, it's the landlord's responsibility. But you may have to take them to a consumer hearing to force it, thus giving your landlord a reason to find a way to keep your bond when you move out.

You can withhold your rent, but keep the money until you go to court and if you have the money in court to pay the rent, the judge can order the landlord to pay for the leak. Your have to do it right though and in good faith. When the landlord tries to evict you send him a registered letter saying you are withholding rent. You might want to research landlord tenant law in your state. You can usually get free booklets at your local legal aid source. There are also books on the subject. Be careful though
the landlord could retaliate several months down the road so you might want to think about saving money to move.
