if there are 2, like 2 cousins for instance, the older one will inherit the property.

it depends on the law on succession of your state/country.
in general, if the owner has no issue/children, the property is inherited by his immediate blood relatives, say, a brother or sister... if all brothers and sisters are dead, any and all nephews and nieces...
if owner is without any relative, the property goes to the state/country... unless he leaves a will whereby he donates the property to any person he desires... |

How about a will? If there is no will your Mom should be the next in line as the wife, not because she paid money. Check the inheritance laws of your state. Talk to a lawyer. Why come to this place? Ask someone who can give you ACCURATE and complete information. If it costs a few $$ getting the right information is the most important thing right now. |

If in the UK:-
If there is a will that will be followed, if not they courts appoint a lawyer to act, they advertise the deaths and ask those who believe they have some entitlement to get in touch. If no valid claims come forward the crown (treasury) gets the lot.
Renting a property from someone or even living there does not entitle the person to claim on the assets - they are merely a tenant. |

Depends on the will left behind. Look for and find the will. Look all over and every piece of paper.
Most states will go to probate in the absence of a will.
My step father died 2 years ago in California and it was a nightmare for my mother because he had not updated his will.
They freezed all the bank accounts for 40 days i think [ state law] but since he had a will the property in his name or with his name on it did not have to go to probate[ where the state decides the fate of the dibursal of property and money owed to creditors blah blah
the will is the key.
