C J S | Whose responsiblity is it to fix, ours or the landlords? |
We are renting a house and there was a crack in the window when we moved in. This morning when my husband closed the door, the crack spread all the way up the glass. Does this mean that we will be responsible or should the landlord repair the window? We had really bad weather last night, the wind was really strong, I don't know if that had anything to do with the crack spreading. The cold air is coming in now, so something has to be done. I just wanted to know what to expect before we call the landlord. Thanks! =) Additional Details When we moved in, I asked the lady that rents his houses for him if I needed to fill anything out on the condition of the house because there were some other things like stains in the carpet that were noticeable and she said no that she had done that. |

You should have made an inspection of the home before you moved in and made a note of any defects on an inspection sheet. If you did that and made note of the cracked window the landlord should pay for it. I said "should", that does not mean he will. All you can do is ask. The alternative is to fix it and then take the landlord to small claims for the cost. Is it worth it? |

If what you say is true, then the landlord knew the crack was there before you moved in, it is the landlord's responsibility. If the cracked window is not in the door then you'd really have to slam a door to crack a window, so I would say the cold had a lot to do with it. Regardless....it's the landlord's responsibility to maintain the building and keeping it livable. |

Landlord is responsible for maintenance of this nature. The window should have been replaced before or shortly after you moved in anyway. If landlord argues, mention "warranty of habitability" issue: landlord must provide a livable space in return for your rent. Broken windows do not make for a very livable space. Check with your city for a renters board, or look for renters guide on-line for your state. that should give you an y firepower needed if he acts like a jerk. Above all stick to your guns, don't let him threaten you with eviction or some other garbage; the courts will rule in your favor on this issue. |

usually there should be a standard clause or understanding that within 2 wks after u shift in any problems that may arises, it should be the landlords responsibilties, maybe u want to read tru the contracts u have sign or the agts verbally highlighted to u about the two wks period for any problems which may arise after u shifted in. Remember tis clause the nt time u rent another house |

Generally anything having to do with the structure of the building (which includes the windows), is the landlord's responsibility unless you have agreed in writing (in the lease) beforehand to have it otherwise. If a defect causes your apartment to be unlivable, then it's a real serious matter and if the landlord doesn't fix it promptly, it could amount to constructive eviction...... which would make the landlord liable to pay your costs to move out and live somewhere else.
Just call the landlord - he'll fix it quickly unless he's a complete idiot.
If the glass was broken because of an obvious accident or vandalism, you may be responsible....but it sounds like it's his problem. |

At least report it to the landlord--if you don't and move out, he will claim that you broke it thus are responsible to pay for it.
A similar thing happened to me when I moved out of my last rental...landlord deducted from deposit cost of repair...I didn't even know the crack was there (I think a car threw a rock and hit it, as it was on the front of the house facing the street but a few yards from my main entrance.) Was it cold, icy weather when your glass crack spread all the way up the glass? That could be a reason for the crack spreading.
Also let the landlord know of any other problems!
Main thing is let your landlord know of any problems when you first notice them! Don't procrastinate! It could cost you in the long run! |

The landlord has to fix this problem. They also must fix it in a reasonable time and if they don't get it fixed in a reasonable time then you can fix it and deduct the cost out of your rent for that month. First you must let them know and give them time to get it resolved.
Also, I would ask to see the list that they made of things that needed to be fixed in the home before you moved in, since this was suppossedly on the list but never was fixed I would ask to see that list and make sure that everything is on it that was wrong with the apt. Hopefully you took pics before you moved in and can take pics of when you move out so that they can't come after you saying they need all new carpet due to you ruining it and deduct it from your deposit. Good luck and make sure that you have everything in writing. |

Landlord should have fixed it when you moved in. If you didn't note it on the walk-through he may claim YOU broke the window somehow and you'll be hard-pressed to show you didn't, so be prepared to end up paying yourself for this repair that clearly should have been done by him. |

If by chance, you have a landlord that won't fix it, go to Lowe's or home depot and get a piece of plexiglass cut to the size of the pane and then seal it in with clear caulking around the edges.
Will cost you about $15.00, but will keep your heating bill from running up. |
