Why does my apartment manager need my 2005 tax return?
I just got a message from my apartment manager saying that she needed me to fax the 1st page of my 2005 tax return to their office. I called back and she said they were going through an "audit" over the next couple of days and they needed from me some kind of proof of income for 2005, the year that I moved in. I asked if it had anything to do with federal rent control regulations - you know, you can't earn more than a certain amount, and still get a decent rent rate - and she said, "No, we're not really concerned about that." I told her that I was sure that what I make exceeds 3x my monthly rent, but she said that wasn't the issue, either. She said that it was not just me; it was several other residents she was calling who have lived here more than 3 years, also. She asked me to get that to them by Thursday, so they could "fax it off" by Friday.

My question is, why does this sound fishy? Can they do this? What ulterior motive could they have; what could they gain? Pleasehelp

She also said they would be calling my place of employment to verify that I still work there. What's up with that?
I still work there, and my boss can verify that, but can they ask him how much I make now?

Umm i would be skeptical of that... anything dealing with my taxes should only be seen by IRS or a accountant that i hire. I would ask them for documentation that they need it... if they say no get a lawyer and decline. without proper documents i would give them nothing. They cannot kick you out for that.

I'm a property manager and I've never heard of needing this. If they're under audit by the state, they may need to show that they performed a proper backround check. Since they didn't get the tax return at that time and they didn't prove your income at that time, it sounds like they're trying to cover their tracks for the audit.

I don't think they have the right to verify ANYTHING once you have been approved to move in. Sounds like you have been living there awhile. It is none of their damn business if you still work or not. And I am sorry, but aint nobody seeing my tax return. I would just say I can't find a copy. You may want to call a lawyer that will give you a free consult so you can ask their advice. This definitely sounds fishy.

If you are in public housing and your rent is controlled by your income you have to comply. I know people who live in public housing and they do get audited occasionally. They just want to see if you lied about your income. Maybe they are the ones being checked out. This could be as well.

Its just an audit, probably something they need to do related to fair housing act or something.

Hmm. Far as I know there is nothing in the laws I've ever heard people talk about that says you HAVE to give this information to the rental company.

I would consult a lawyer about it truthfully, if they were just asking to verify work that's no biggy. But with your income tax return they can do all sorts of things. If I had your income tax return in front of me, I could try to obtain credit cards and other loans, because everything I would need in the world is on your tax return, SS, Birthdate, Current Address, Current Employers etc.

I would be hesitant if I were you, and even though it might cost you a few bucks, I would consult a lawyer.

I personally feel that since it is 2005 there is not much danger in it. It is nothing recent and all personal information they need to do danger they already have. They may be having an audit with the irs because maybe they were giving people cheaper rent and shouldn't have. I do not know I would definetly ask more questions if you feel concerned. For my first apartment the people in the office could have asked for anything and I would have given it to them with no thought.
Now however the apartment I am in now I did not even want them to have the information they have now. So it all depends on the people. See what will happen if you say you do not have a 2005 return. This way you can not get it if you lost the papers per say. See what will happen if you just refuse. Can they kick you out? I would think not if you have been doing everything right.

and for the others that say the information on income tax the could do this and that well they already have that information when you rent from them, they have you SS# birthdate jobs all that so that can change anything there if they were going to do bad that way they would not need income tax because they already have it

Just my 2 cents, but wouldn't a W-2 and 1099's show what you made? They shouldn't need to see what you filed. That page would show anyone you filed with and dependents as well as your gross adjusted income.

I don't feel that they need this other stuff.

Oh, and if they call your employer, they can only verify if you work or worked there and what your position is.
