~Kim~ | Why is my rent due on the 1st, when my move in date isn't until the 7th? |
Rent is due on the 1st period. No grace period or I incur a $100 late fee.. I talked him into a 5 day grace period... Shouldn't my rent be due on the 7th of every month? If not, I'm paying for a 6 days I won't even be there??
Thanks! Additional Details I've been cleared already.. I will have waited 30+ days to get in there... Aren't I paying for 6 days I shouldn't be?? |

rent due on the first is industry standard. this way, the landlord doesn't have to remember or keep track of dates for every tenant. he knows that his money is due for everyone on the first, period. now, as your move in date was the 7th, your first month should have been prorated to reflect that. this means that a portion of the first months rent feflective of those 6 days should have been deducted. the 2nd month and all will be the full rental amount as specified in the lease. hope that helps. |

your first month should not be a full month payment and you are supposed to pay it on the day you move in. from then on, your rent will be due on the 1st. |

In my renting experience, rent has always been due on the 1st of the month, regardless of when I moved in. Usually, your rent is prorated the first month you move in (i.e. only charged for 7th to end of month in your case). |

Your rent should actually be pro-rated. You should not have to pay for the first six days that you are not living there. From that point on your rent should be due the first of every month. Good Luck |

If the landlord isn't going to charge you for the week that you are there when your lease is up I don't see what the problem is.
Rent is usually due on the 1st because management companies don't want to keep track of everyone's move-in dates and expect them to pay on that day. Can you imagine what a pain that would be? |

rent is always due on the first day of the month. most places have a 5 day grace period as you stated. however if you signed the lease on the first, even tho you are not moved in you are renting the unit. usually if you move in or out in the middle of the month most landlords will prorate the rent. |

Hi,
As a Landlord I would have prorated the first month. The rent would be due on the first of each following month. |

are you not being allowed to move in until the 7th or is that just your decision? what day are you physicially getting the keys? if it is the 7th, then you should not have to pay rent for the first 6 days |

I think it depends on whos renting it to you. If that doesn't matter and there is actually a law I know when I moved into my place the rent was decreased a little for the first month because I moved in late. |

Technically rent is always due on the first regardless of your move in date for example if you don't move in until the 20th you will pay for those 11 or 12 days but you will still owe rent come the first of the following month it makes it easier on the landlord to have rent due on the first day of every month.
However, if you aren't moving in until the 7th of the month you should be prorated for that month. Most LL's however, prorate the second month of the rent and charge you a full months rent for the first month, that way if you move out before the second month he has received a full months rent from you rather than a portion. However, if you've received the keys and there's something preventing you from moving in on the first of the month other than the LL i.e. moving company or friends can't move you till the 7th then you owe the entire month with no prorations. As soon as you have the keys it's yours.
Rent is due on the first regardless of your move in date. |

I guess it depends on why you aren't going to be there until the 7th. Any place that I have rented would prorate the first month based on the day I could get in - as in, they had someone move out on the last day and needed time to replace the carpet, etc.... Rent was always due on the first, though - that is just standard. It would be a pain for management / landlord to have to deal with getting funds in all through the month. |

Why are you not asking the landlord these questions?
It could be that the landlord refused to rent to you unless you started paying rent on the first.
It could be that he requires a full months rent for the first month and then he will prorate the second month or the last month to adjust for that.
It could be that a mistake has been made.
It could be that he will prorate the rent but requires that prorated amount to be paid on the first.
Talk to your landlord. |
